Hi everyone,

Listen, before all, I have read every post regarding this matter, and I know it is not a "good" thing to do, but let me explain everything. I just got NOA2 with approval of the visa. My question is, can I have a wedding party (nothing signed, no paperwork involved, just a celebration) during the 6 months that I have to enter the US since I have my Visa on hand?

Notes:

1- I live in Argentina, a wedding party doesn't mean anything legally if we don't sign any paper.

2- This would be a SECRET celebration, just very close friends and family... No more than 50 people, there will be NO pictures (besides a professional photographer) and cellphones are not allowed in the party. No social media posts neither from us nor from any friend or family, so there is absolutely no evidence this happened.

I'm letting you know this because I know about the "too married" for K-1. But since I will already have my visa on hand, the only possible "conflict" would be at the Port of Entry, and Officers would know nothing about the celebration I had because there is no evidence at all.

Your choice....your risk (small)...your consequences.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

have you gone through your visa interview at the embassy in Argentina? if not you still have that to do before receiving the visa. NOA2 means the United States has approved your USC fiance's petition (i129-f), the embassy in Argentina still has to approve your visa (K-1).

 

I would also say not to have a party like that.

the marriage is just a signed piece of paper

you can have the party whenever, AFTER you've signed that paper in the US

After going through this whole process just to risk it all to have a party? Admittedly as @Crazy Cat said, the risks may be small but the consequences are huge. I would not even be in the same zip code of an event that could be misinterpreted and jeopardize everything I have worked for. Just my 2 cents since you asked :)

But now you are in the US and want to adjust status from your B2? Or have you decided to stick with the K1 after all?

Even with visa in hand the risk is still there.

Some cranky person in your life can report the "wedding" to the consulate. The CO could also be looking at social media and see something themselves and ask for the return of the passport to cancel it.

 

At the POE, if you misspeak and say anything about a husband/wife they will turn you around. They have been know to try to trip ppl up to see what they would say. For example I was asked if the ppl with me was my husband. I said well we're not married yet and that was his mom. They look to see if you would just answer with an automatic Yes.

 

Then at AOS you start submitting evidence. They already have all your social media info and in your Case you have 50 ppl attending, taking pictures, posting on about 50+ social media sites.  These posts will show clearly a wedding that was prior to your entry. Kiss your fiance good by as now your K1 was invalid at time of entry. 

 

Is this dramatic maybe, but this stuff does happen. Heck of of our very own members went to her brother's wedding and was drilled about it. 

 

So how much of a risk do you want to take? 

 

Have a huge going away party, but no wedding attire, no formal attire of any kind.

I don't think you have done enough research if you have come to the conclusion the an NOA2 is a visa approval. You have to have the embassy interview first, and as others have recommended, don't have the party.

This right here... As someone very familiar with Latin American culture, these things are very common in the culture and do happen.

one woman was returned home at POE and they said "too married for K1 visa"

how did the CBP know or Judge?   she took engagement ring off thinking it would look like married and tan lines were everywhere but under the ring on left hand

she tried to say engagement ring and they said "no reason to take that off" and returned her home on next flight out

Lol so you know the risks but you want to go ahead and take it?  Some thinking tho..

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
