Hello,

 

So, my Fiance (25F) and I (24M) have been dating for more than 1.5 years. She visited me several times to my home country (Argentina), and I visited her 4 times during our dating time. I also have siblings and uncles there in the US. I am in the US right now on my 4th trip to visit her, I entered like 50 days ago. Things happened and we are thinking of getting married here and apply for Adjustment of Status, since we don't want to be apart anymore.

 

My initial intention wasn't to stay and apply for AoS, but *love* happened and we are deciding to start a life together here (at the Port of Entry I said that I was entering to visit my fiance and siblings). We've read that we should probably get married and apply for AoS after 90 days of my entrance. My question here is, am I gonna face any problems regarding paperwork if I decide to stay? We have more than enough proof to show our relationship is bona fide, but our fear is me facing problems for Visa Fraud or something.

  If you are going to stay, you need to marry and file for adjustment ASAP....before your I-94 expires.  You do NOT want to wait.  Once you file a proper I-485, you will be granted authorized stay in the US until the I-485 has been adjudicated.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There is no 90 rule for USCIS.  Personally, I would not purposely wait until after 90 days.  Just be prepared to not work or leave the US for an extended period of months.

Your other options are to marry, leave, and start the spousal visa process, or leave and start the K-1 visa process.

Okay, I have 180 days due to my B2 visa. I plan to stay here, not really want to leave.

But my question is different... Am I going to face any kind of problem when filing for AoS? Since I entered the US on a B2 visa and pretend now to became a permanent resident. Are they going to go through a deep investigation of me and my intentions at the port of entry?

Yes, your immigration timeline may be questioned, it's always a possibility.

They asked about the purpose of my trip, it was just visiting siblings and fiance, and then follow up question, are you planning to go back home? And of course I said yes (I have a return ticket).

I'm not gonna lie tho, there might be some texts before my entrance, talking about "what if I stay once I go?", but nothing actually planned. I don't know at what extent the investigation goes, like can they ask for chats records and go through your phone? Because I don't know what's there and if there might be any of those texts

Return ticket means nothing, what about job, home etc? You didn’t give those up before arriving I assume? So should be fine if you do get questioned at interview. 
 

If you’ve got any concerns, it might be worth considering going home and applying via consular processing. But only you know what your true intentions were and what evidence of it there is.

No! I didn't give anything up, I have my job, to which I have already spoken to, telling them if I stay I'll probably quit, and home wasn't a problem since I was living with parents back in Argentina.

 

Besides maybe some texts messages I doubt there is much more evidence of "misrepresentation" of my intentions when I entered here. Do you think it is relatively safe for me to apply for AoS?

Also make sure the sponsor is financially capable of supporting you. You must include i864 and i693 medical with your 485

Yes! my girl is amazing and have a good job, so she is more than capable of supporting me.

I guess imma go ahead and just apply for AoS, they don't have any proof against my first intentions, or that's what I think 😛

I also suspect a troll as they are hitting on two somewhat controversial topics, AOSing on a B2, and having some sort of engagement party before getting a K1.  Additionally, the member only joined on Tuesday.
