Hello,

 

I am in the process of applying for a GC through marriage. Was on a J1 before.

 

So my problem is USCIS couldn't run my card for the different fees. So they are sending back my case to my lawyer. We sent the case to USCIS on January 2nd, it's now January 28th and still nothing came back, is that normal?

Also, what is very much worrying me is that the grace period of my J1 comes to an end on January 31st and I'd hate to be an overstay, would that be the case? It is very annoying especially when I sent everything on time...

Yes, it's normal.  I have seen it take a month or more at times.  If you are certain the package was rejected, I would send a new package with payment by valid check.   If you overstay, you will not be granted authorized stay until a proper I-485 is received by USCIS.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If I overstay for a few days until they process my case, would that impact my case?

Assuming your petitioner is a citizen then no, overstays are forgiven for spouses of USC’s. But with the current administration I wouldn’t risk being out of status for any time at all personally.

Does the fact that USCIS had my case before the end of my visa changes something? Even though they sent it back because of that credit card issue... Which date will they keep?

No.  It just means you haven't sent an acceptable I-485 yet.
