Should I be worried or more patient? 

I recently became a US citizen. I mailed a I-130/I-485 package to the address provided by the USCIS website via UPS for my daughter who has been living with me legally under the TPS status for Ukrainian immigrants. She already has a work authorization card. The package was delivered a month ago. I have not yet received any notice nor have they cashed the check I sent. How can I check the status on this?

Don't forget, a month ago was Christmas. Then followed shortly by New Year and January 9th. At least those three days USCIS was closed.

 

 

Yes. That’s why I was asking if I should be more patient. Seems longer time than I had experienced in the past.

And MLK Jr. Day on 1/20/2025... plus a lot of government employees use some of their vacation days to extend those federal holidays into 4-5 day weekends and/or weeks off, so add in USCIS being short staffed basically for the whole of the last 6 weeks

I’m nervous with the new administration. Not sure if there’s a backlog or if I should be more patient. Thank you

I’m not sure if they will accept the I-130 if you’ve filed concurrently, or if you’ll need to refile that.

Very good catch! I didn't realize it, though she was a minor.

Unfortunately it seems not. I think the whole package will be being sent back to the OP and he’ll have to file a standalone I-130 instead.

I was under the impression that since she is already legally in the US I could file both concurrently. I hope I’m not wrong 🙏

If she was considered an immediate family member of a US citizen, she could.  However, she is an F2B  F1 visa category.  Her priority date is far from being current. It will be more than just a few years.  She cannot adjust status (submit an I-485) in the US unless she maintains legal status until her PD is current.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
