Hi all,

 

I came across some info on the Enumeration Beyond Entry (EBE) process, which sounds like an SSN can be provided through USCIS and the AOS process, removing the requirement for a K1 to visit an SSA office pre or post marriage. Has anyone heard of this and knows if it is advisable? Info is:

 

You may not need to visit a Social Security office or Social Security Card center if you apply using the Form I-765 (Application for Employment Authorization), I-485 (Application to Register Permanent Residence or Adjust Status), if you are approved for any of these applications through USCIS, and elected to apply for an SSN. USCIS will collect information on behalf of SSA to process the SSN card. [https://www.ssa.gov/ssnumber/ss5doc.htm]

 

Under the Enumeration at Entry (EAE) program, any lawful permanent resident can apply for both an immigrant visa and a Social Security number (SSN) by filing an immigrant visa application (Form DS-230 or DS-260) at a Department of State (DoS) office in their home country. If the visa is granted, DoS transmits the identifying information from the person's visa application to the Department of Homeland Security (DHS). I came on a K1 and the first thing I got was a SNN, about a week? after I entered.

 

Next opportunity is once you have your EAD.

Not advised to get the SSN with the I-765 or I-485.

It is best to get the SSN with the passport and I-94 as soon as possible at the Social Security Office because the I-765 or I-485 approval can take several months or more.

You will need the SSN sooner to open a bank account, get a state id/driver's license, sign up for utility bills, etc.

We got Jaycel's SSN about a week after she arrived (In her maiden name). This allowed us to add her as a joint account holder on my bank account and credit cards. Then when we filed the I-485 and I-765, we filled in her SSN where it asks on the forms, checked all the yes boxes (i.e.: "Do you want the SSA to send a new cad?) and used the forms to do her name change by putting her new, married name in the "Legal Name" section of each form. When her I-765 got approved, 7 days later she received her new SSN in the mail with her married name on it. (It still has the disclaimer, "Not Valid for Employment Without DHS Authorization", which is fine because she now has her EAD Card. We also did the SSN part on the I-485 so that, when approved, the SSA will send her a new card with that disclaimer removed.

I would not wait, if possible. 
 

Waiting means you are delaying the opportunity to add to bank accounts (if the bank requires) and you delay the opportunity to build credit. My state will not allow anyone without a SSN to apply for a drivers license (I would ask your state license bureau). 
 

We are barely in a new administration, which means we do not yet have any indication on processing times.
 

We chose not to wait and we got my husband’s applied for online once the I-94 was ready, then went in person a week later and finished applying. We were able to put his SSN on the AOS and EAD paperwork.

Getting a SSN through submission of an I-765 and/or I-485 has always been possible.  However, there are advantages to obtaining one as soon as possible.  That is why seasoned members of VJ ALWAYS recommend applying BEFORE marriage.  See the instructions here :

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I will echo the above comments.  When entering on a K1, it is best to do the SSN as soon as possible since it will help with so many other things a newly married couple needs to do such as co-mingling their lives.  As mentioned, there are other routes to a SSN, but these are less desirable for a K1 entrant.  Btw, going to an SSA office is not that bad, just don't plan on going first thing in the morning.
