If there is a problem, USCIS will issue an RFE

Hi everyone,

I am writing on behalf of my friend whose I-485 is pending for while now.
She wants to apply for FOIA to see if there is anything that is causing this delay. Do you guys think that FOIA would be any helpful?

Thanks

This is posted in the wrong forum.  From what status was the I-485 filed?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

She came on tourist visa and got married 5 months later. So she filled I-485 through marriage.

What forum could she go to ask this question? Would you happen to know?

I just moved it to the Adjustment of Status from Work, Student, or Tourist Visas.  You had posted it in the Removal of Conditions forum.

Oh sorry, I didn’t notice that. Thanks for moving it.

How long is ‘a while now’, when did she apply? She could file a WOM if it’s way beyond standard processing time.

It’s been 1.5 year since she submitted I-485.  She had a situation with her husband’s ex girlfriend 8 months ago. The cops were involved. No one got arrested.

Any idea which Field Office? 18 months could still be well within standard processing times depending on that. https://egov.uscis.gov/processing-times/

Chicago field office. When the cops arrived to the incident, they wrote a report. Now her name is on it and she is worried if that is going cause any problems. So I am not sure if FOIA request can be helpful to show if there is something that she needs know about.

OK, so there’s no delay - it’s showing 23 months processing time for Chicago. They probably haven’t even looked at her application yet and if nobody was arrested in the incident, it shouldn’t be an issue.

I think she just needs to wait and hopefully she’ll hear something soon.

Yea it says 23 months, I see it now. Hopefully she will hear something soon.  She wouldn’t be worried if this incident didn’t happen. That’s why I wanted to check if anyone ever requested FOIA and how does that look like, what does FOIA reveal, and is it helpful at all so she can get a peace of mind.

FOIA will only show forms/docs submitted. For peace of mind she can run her own FBI prints ( cheap , fast and easily available). That will show No Arrest Record and she can rest easy. If there was only an incident report and no one got arrested , it will not pop up anywhere .

She should not offer any details to USCIS at any time. …even if it was a bit of Jerry Springer action 😂
