Hello,

I’m from Canada currently in USA jobless for 2 years & waiting for husband’s H1B to get approved so I can get my work visa. Is there any alternative ways to get my own independent visa? I currently have diploma in Business administration from a private college in Canada.

What are my options to further with my studies? What are the chances my husband will get his H1B? What are some ways to get my independent visa ?

Can you clarify, what status have you been in the US for 2 years on? What is your husband’s current status? How is your husband’s H1B related to you getting a work visa? Spouses of H1B holders can’t usually work. 

 

What work experience do you have? Just a diploma isn’t likely to be enough for any employer to be prepared to go to the cost of sponsoring you.

Maybe a F1 that would then qualify you for a TN

Exactly - H4’s aren’t usually able to work. They can apply for an EAD in certain circumstances, but OP hasn’t mentioned that.

You will have to clarify further where you are and what your status is.  Your options are limited - you can go back to school and get a degree that would allow you to obtain a TN or H1B of your own or look at an investor visa, as mentioned previously.

The only way for you to get your own independent visa is to find your own employer. If you have a specialty occupation, then you may find someone to sponsor your H1B or you can enter under the TN, if you meet the requirements, but a diploma won't be enough.

 

You can only work on H4 status when you have an EAD and the only way to receive this is if your spouse has an approved i140. If they do not have this, then you cannot work under H4.
