I initially entered the USA on an H1B visa in September 2018, which was later converted to an L1A as a Program Manager. However, during the EB1C initiation process, concerns were raised by the attorneys regarding the legitimacy of the L1A conversion and my offshore managerial experience.

To address these concerns, I relocated to Canada and took on the role of a Consultant, continuing to perform managerial responsibilities as outlined below. My company has now initiated the L1A process from Canada, emphasizing my offshore managerial capabilities. However, as my Canada Work Permit designates me as a "Consultant," I would like to confirm if my current role, with its managerial responsibilities, qualifies for both the L1A and EB1C processes.

Based on your feedback regarding EB1C eligibility, I will decide whether to proceed with the current L1A application or consider relocating to my home country for one more year in a confirmed managerial role.

Key Responsibilities Include:

  • Business Strategy Formulation, Revenue Generation, Research, Planning & Development
  • Program Management, Project Planning, and Execution
  • Team Management
  • Performance Evaluations and Mentoring
  • Status Reporting and Operations Oversight
  • Quality Management and Budgeting
  • Staffing and Resource Allocation

I think I’d take your lawyers advice on this, they’ll know far better than us what your job entails. One can be a ‘functional manager’ and not manage a single person but still qualify for L1A.

Seems odd to be described as a consultant but I agree so many questions but the Lawyer will know the full situation
