if i were you I would just use the new one.

save yourself the hassle of potentially getting another rejection for using the wrong form.

 

plus they would only accept the old form if it was post marked before feb 10th. and we are well past that.

 

since your case was never officially created, i don't think they would give you a pass on that.

my thought is if the envelope is too thick/big it doesn't get scanned for informed delivery.

AH, that makes sense. When I saw how thick it was, I knew it was a denial.. Atleast they got back to me lol. Its funny because the date on the I-797C is feb 11... 2 weeks later LOL

When looking at the document online on MyUSCIS since I haven't received it in the mail yet they need to receive my response by May 22 so I have a some time to do everything. The SS card should be here by the end of this week or sometime next week. Should I wait though even if I file this years taxes I should wait till they at least accept them right? Be kinda weird if I sent them to USCIS and come to find out IRS says I filed wrong or something else went wrong.

Do you plan on E-Filing? If so, the IRS accepts the return pretty quickly

When they accepted my filings for my wife I have the tracking that says it was delivered on 1/11 but my notices from USCIS says they received it on 1/10 lol

I use turbotax so in a sense e-filing. I think it would be better if my return was approved not accepted. Hate to send to USCIS then to find out something is wrong.

Yes I used Turbo Tax also and my return was approved and the Tax Return Transcript showed up on the IRS website about 15 days later.

My RFE for now they only want: The petitioning sponsor, ME, on form I-864 Affidavit of Support, must submit a complete Federal income tax return submitted to IRS for the most recent tax year. If he submits a transcript it must be a "Tax Return Transcript" from the IRS."

Did you send a 2023 tax return or 2023 transcript with the package?
