Trying to do my taxes now and I am filing married jointly but with turbotax one of the questions is if my wife is a nonresident alien or dual-status alien spouse. It's a checkbox. Do I check it or not since we filed for her greencard but she doesn't have one yet. Not sure the correct answer.

Since she has a SSN she doesn't have to be marked as a nonresident alien.

 

You can considered her as a resident alien for last year only for tax purposes. But you have to include all foreign made income. So if she worked last year you have to include it.

 

We ended up paying someone to do our taxes cause it was too confusing lol

Thank you for the reply. She wasn't working for a few years while in Philippines so there's no income to report. I filed married jointly so hopefully that is ok. For next year would I have to change anything resident or non resident when she gets (hopefully by end of this year) her green card?

Ahh ok

MFJ was fine then. Yours was much easier since she had no income to report lol

 

If you didn't mark her as NRA, no I don't believe so, you can just file normally.

My husband tried to get his access code yesterday after he got the text and the agent he spoke to said no 😅 probably because it didn’t have time to even get to us by mail. 
 

It does say on the case checker that they schedule his biometrics! Hoping that since the online access code was mailed on the 27th we get it early next week.

Yep, for a process that takes months, whether you get access code today or next week isn't going to change much. Biometrics should be 2-3 weeks away.

i just checked our case number and my husbands biometrics where scheduled as well!

 

that's what we're hoping for too lol

Yes - he was just hoping to get an idea of the time I need to take off work. We have a bit of a drive, is all 🙂

 

Also I might be a bit impatient. My husband is better at waiting than I am. 😅

Thanks so much for this!! I am going to use it as my guide as i am about to file.


I have 2 Questions, if someone can help.
1) I thought if you filed 485 and 765 together the fee was waived for the 765?  Is that not the case anymore?
2) What happens if the embassy keeps the DS-3025 despite having accepted receiving all the vaccines?

It's not the case since April 2024

They will keep it. You need to ask civil surgeon for a copy when you go to exam.

1.unfortunately it is not included anymore. however ,the fee is reduced some if you file the I-765 in the same package as the I-485. so the I-765 is only $260 instead of the $550.

2. the physician who did the exam should have given you a copy. if they didn't you should be able to contact them to get a copy of it.
