Well since we got denied I also opened our joint bank account today and added it to the proof before we send it off this afternoon. Guess I won't have to do that online anymore!

Hey everyone. Sorry if this has been answered, but I could not find it anywhere. I see a lot of people submitting evidence of their bon-a-fide marriages. While I do have a lease in both our names thats really all I could get in my wife's name without a SSN (joint bank account, bills, etc). My wife is the one submitting the AOS. I do not see anywhere on the USCIS website to submit evidence of a bon-a-fide marriage on the I-485. I see this required for the removal of conditions form. So... is this really necessary to submit? Does anyone have any links to where this is recommended or advised? Any rejections if I do not submit this type of evidence? Thanks!

I'm unsure if its absolutely NECESSARY, as I can't find it in the instructions of the I-485, after you filed and you get your receipt, you can continue to add evidence online. However, it'll be hard to do so if you can't add her to anything. I'm assuming she's been in the US longer than 75 days?

It is not a requirement, you can include the lease if you want, and any photos you might have of getting married is also an option.

The only requirement is the proof of marriage, which is a copy of the marriage certificate

 

Adding anything else is just extra

Basically its not in the list of requirements, however to solidify our papers aside from the marriage cert, we try to show them those shared assets and liabilities...

 

Also we are getting tips and tricks too from the people that came before us in this forum... our visa veterans! LOL..  atleast we do not need an attorney that charges big amount of fees just to gather requirements and lodge this applications.

Yea longer than that, expired I-94. I saw that you had to refile and now you're also dealing with an expired I-94. How did you guys answer the unlawfully present question on the I-485 (Part 9, Question 76)? It makes it sound as if we entered illegally lol... but I assume you have to check yes, and then put the dates from the time your i-94 expired to present?

We crossed yes on 13 and 76.  For my explanation I put this on the last page:
'Due to my first I-485 getting rejected, as I mistakenly marked 'Spouse of a U.S. Citizen' instead of the K-1 option, I am now sadly filing my I-485 after my admission expired on 01/30/2025. I will include a copy of my I-797C which shows I originally filed before 01/30/2025' 
and
'As mentioned in the explanation above for page 14, part 9, item 13, I got my first I-485 rejected due to mixing up the spouse and the fiance(e) option for page 5, part 2, item 3a. Because of this rejection, I am now past my admission date and unlawfully present. I will include a copy of my I-797C which shows I originally filed before 01/30/2025'

I'm not sure what your explanation would be as I don't know your case, but that's what I did.

I'm not sure what your explanation would be as I don't know your case, but that's what I did.

Well from what I hear, a lot of people have filed their AOS after their I-94 expires for K1 visa for various reasons; economic, marriage dates, certain paperwork, etc. Getting married and filing the I-485 before the 90 days its actually quite difficult and if you do manage to get that done kudos, but the majority I believe are out of status. My reason is mostly economical but regardless, your input helps! Thank you!
