we also checked the "spouse of us citizen" box...

 

guess we're gonna be expecting to have to refile again 😭

Can I just file a new submission before my current application is rejected (as I already know it will be rejected)?

do you have a copy of your first filing? the one that was accepted but then the payment didn't work?

I don't have a copy but I am 100 percent certain I crossed that on that one too.

could be one of those "depends on the person adjudicating it" things.

 

maybe just fill out the forms again and have them printed and ready to go in case it does come back

I feel like this could be a “person adjudicating” specific. Is K1 entrant probably the answer they want? Yes. Is Spouse of USC an incorrect response? Not entirely. 
 

I understand we have to do what the system demands, but what a silly difference. Particularly since the “fiance” option doesn’t mention being married now.

It is not a "person Adjudicating" thing. If you check "Spouse of US Citizen" they then are required to have an approved or concurrently filed underlying petition for immediate relative of USC (Like an I-130) in order to process you under that category. When you check "Person Admitted as a fiancé(e) of a US Citizen...." they know that you already have an approved underlying petition for your non-immigrant entry  (The I-129F)

I was not advocating for others to check the wrong box - was simply trying to give others hope that their form gets accepted. 
 

I understand what the government wants after reviewing it again. I do appreciate your insight.

Understood.... I just want the others be prepared for a rejection because the lockbox has to reject it. Sorry everyone. If you checked the "Spouse of a US Citizen" box and you came on a K-1 visa it's gonna get rejected. Unlike the actual USCIS Adjudicating Officers who have some discretion for interpretation, the lockbox employees are contractors who have no latitude. :(

Yeah this was my same question too prior... luckily found a DIY tutorial for forms thats specifically follows a K1 journey in YT so did change lots of things from my original answers. 

 

I just attached the channel I followed as it is somehow recent and her form approved. Just make sure to use the new forms.

Just be advised that video is old enough that it is using the old version of the I-485.... Most of it is translatable but there are some differences

Indeed, just get the main gist of it.. the form is also different too already as a january filer. And there is a new one too now.. i think one page was added... 

 

And search for more as I have watched more than one vid too..  And even  googled whats the difference of this and that answers as sometimes it seems like an easy question but still tricky. 

 

So good luck everyone. Hope all goes well in this journey.  Let us not hesitate to ask questions here too if we are in doubt. I know i spent a bit time on the PUBLIC CHARGE question, some says YES, some says NO. But i did for YES in reference to more approved forms I encountered from approved applicants.

i found another difference between the old I-485  that i feel like leads to the confusion on the question from above.

on the old form this is how the first few options look

it specifically references form I-130

on the new one, it doesn't put the form number next to its relevant filing status. just at the beginning

if it still did have the form number next to each, i bet there would have been far less of a chance that we all would have picked the wrong one.

Thats a good comparison. The new form looks entirely different, old one is much more defined when it came to forms. Can be tricky indeed.  Its apparently 4 more pages now in the new form as they removed columns and rearranged wordings too.
