Hey everyone. I noticed that this month didnt have a topic yet. So here goes. Welcome message copied from November 2024, with changes to reflect my submission.

Welcome to all AOS filers for January 2025!  Following the example of other users, I'm taking on the task of starting the thread for us, in order to track our progress.

 

We all come from a variety of situations, so please reference the Immigration Guides for your AOS filing directions.  Feel free to share your procedure/progress in the comments below!

 

I arrived on a K1 visa on December 5th and we were married on December 12th.  We filed on january 8th with the following packet composed (this is a copy of our Table of Contents):

 

I-485 Cover letter Itemization:

 

RE: ORIGINAL SUBMISSION of Form I-485 Application to Adjust Status as an Immediate Relative of a US Citizen (Spouse)

 

Enclosed please find my form I-485 Application to Adjust Status as an Immediate Relative of a US Citizen (Spouse). Following is a list of contents included in this application, in the order in which they appear:

 

·       Payment for the filing fee in the amount of $1,440 made payable to US Department of Homeland Security

·       Two 2x2 Passport Style Photos of Applicant (with Name and A-Number written on the back)

·       Cover Letter –  (This Document)

·       Form I-485 Application to Register Permanent Residence or Adjust Status (Signed by Applicant)

·       Copy of my Passport Biographic Page

·       Copy of my K-1 Visa Passport Page with stamp showing Inspection and Admission issued by US Customs and Border Protection at Tampa International Airport, Florida on December 5 th 2024.

·       Copy of my most recent I-94 Record

·       Copy of my Dutch Birth Certificate and a Certified Translation of said certificate

·       Copy of Form I-797C Receipt Notice (NOA 1) & Approval Notice (NOA 2) for the Form I-129F, Petition for Alien Fiancé(e) filed on my behalf 

·       Copy of the K1-FTP NVC Letter from the Original I-129F Petition

·       Certified Copy of our Marriage Certificate

·       Medical Exam Requirements:

o   Cover Letter RE: medical exams for K-1 Non-Immigrant Visa holders adjusting status who have completed a medical exam abroad within one year of filing form I-485

o   Copy of my DS-3025 Vaccination Documentation completed by a panel physician during my Immigrant Medical Examination in The  Netherlands , confirming voluntary completion of all vaccination requirements.

·       Additional Documents – Proof of a Bona Fide Marriage

o Photos of visits to friends, family and attractions prior to wedding.
o   Photos taken at our wedding and celebratory lunch on December 12 th , 2024.
o   Copy of our amendment to the apartment lease (joining applicant on lease) for
the remainder of current lease (until February 2025).
o Copy of signed joint apartment lease from February 2025 until February 2026.
o   Copy of our first joint bank account statement at our bank.

- Documentation Regarding J-1 Nonimmigrant Exchange Visitor Status

o Copy of form DS-2019
o Copy of available Form i-94, Arrival/Departure record pertaining to J-1 visa.
o Copy of J-1 visa passport page with entry stamp in J-1 status. 

 

·       Form I-864 Affidavit of Support, Under Section 213 of the INA completed and signed by my husband along with its supporting documents

·       Payment for the filing fee in the amount of $260 made payable to US Department of Homeland Security (filing concurrently with form I-485)

·       Two 2x2 Passport Style Photos of Applicant (with Name and A-Number written on the back)

·       Cover Letter – (This Page)

·       Form I-765 Application for Employment Authorization filing as category (c)(9) (Signed by Applicant)

·       Copy of my Passport Biographic Page

·       Copy of my K-1 Visa Passport Page with Stamp of Admission issued by US Customs and Border Protection at Tampa International Airport, Florida on December 5 th 2024.

·       Copy of my most recent I-94 Record

We're about to file ours.. Exciting!! Am I correct in seeing you didn't file an I-693? I thought we were still required to, just didn't have to get a new exam etc?

You cannot file I-693 without new exam practically. And there is no need to file I-693 if DS-3025 has box "K Visa applicant voluntarily completed vaccination requirements" checked.

Oh interesting. So you just need to add your DS-3025 and don't need the I-693?

Yes, copy of DS-3025 if correct box is checked.

 

This is only for K-1.  Others adjusting status are required to submit I-693.

Just checked mine and it was checked. Awesome!! I was already so confused on how to do the I-693

Sent my file 485 and 765 last Jan 2.. yet snow storm and all in our area, arrived in Phoenix last Jan 11... 

 

Received the text today, both files were received dated Jan 13!

 

So good luck... 😄

 

I really wish biometrics would be quick as I really do want to work now lol

The answer has already been given but just to confirm: as an adjuster from a k1 visa you do not need to file an I-693 if your ds-3025 has the box checked that says you voluntarily completed all vaccinations.

Indeed! USPS took almost 10 days to deliver my package but well it was a snowstorm.. we could have been on same timeframe with JL.

We also filed at the Phoenix Lockbox and Jaycel got the I-765 approved in 51 days from the date of receipt. Pretty happy with that. Her EAD Card should arrive in the mail tomorrow if the tracking is accurate.
