Hi, I'm the petitioner and I'm assembling all the documents needed to send the I-129F application, we plan on sending it off today but we're not sure if we should include that my beneficiary met me last year using an ESTA and returned to the UK a month before her total allowed time to stay in the US. We think that it shows proof that we met in person amongst all the other proof her I-94 travel record, boarding passes, e tickets etc. We've seen that apparently it's a red flag to show an ESTA in the K1 VISA application as evidence and we're not sure? Does anyone know if this is true, if it should or shouldn't be included?

an ESTA doesn't necessarily prove you met in person. ESTAs are valid for 2 years or until the passport expires, whichever happens first.

proving you met in person is better shown with the I-94, passport stamps, boarding passes, hotel bookings, pictures together. passport stamps/I-94 prove that they were inspected at a POE and were legally allowed to enter.

 

theres no need to include that they used an ESTA.

 

my husband also used an ESTA to visit me, it wasn't included cause in the instructions for the I-129f it doesn't say it should be.

the ESTA just isn't relevant
