Hi, I'm the petitioner and I'm assembling all the documents needed to send the I-129F application, I've had 3 traffic violation charges (all misdemeanors), all of which are under $500 (speeding ticket, no proof of insurance and car was not registered but then I proved I had insurance, no seatbelt which was about 8 years ago). No money was left outstanding but I'm seeing a lot of mixed information about people receiving RFE's for not including court documents for the same offences. I have never been arrested and I have no criminal record, only traffic offences that are, again, under $500. Should I include this information in the K1 visa packet anyway? I don't want to delay the case by providing unnecessary information or hurt my case with it, but I also don't want to delay or hurt my case by potentially omitting this kind of information.

The only reason that they would get an RFE for not providing court documents for those offenses is if they listed them on the petition. If you list them, you have to provide documentation. You do NOT have to list them. From the I-129F instructions for Item Number 4.a. Criminal Information:

 

Unless a traffic incident was alcohol- or drug-related or involved a fine of $500 or more, you do not need to provide information on it.

Okay so just to make sure, it would then be perfectly fine to NOT list any of this in the I-129F form? I saw somewhere that you wouldn't need to provide information but you still have to list the offence to be transparent? So sorry if it sounds dumb It's just difficult seeing conflicting information out there.

No worries! These forms can be nerve-wracking :) When they say "You do not need to provide information on it." in the sense of answering Item 4.a. that is the yes or no question so you do not have to answer "yes" if it is not alcohol or drug related or if the fine was under $500
