Hi, I've been using VisaJourney since mid 2023 and never felt the need to make an account until now, due to how detailed and useful the information posted on here has been to us (my wife and me) so far.

We've received an RFE for the I-864 we sent in with the I-485 AOS packet. There are no specifics listed and my wife (who is the petitioner and sponsor) makes more than is required when referring to the I-864p for a 2 person household. I'll include the "What You Need To Do" part of the RFE below.

We included 6 months of pay stubs and her (the sponsors) 2023 IRS Tax Return Transcript.

 

A joint sponsor sadly is not an option. 

 

I hope I have provided enough information for anyone looking at this to be able to help figure out what the missing piece of the puzzle is.

 

Does anyone have any advice on what to respond with?

Was proof of US citizenship provided? 

Were all pages of docs provided?

How much higher the income was compared to required minimum?

 

I'd if she made 50K+ in the last 3 years, it should be approvable.

Did you keep a copy of the I-864 and supporting documents that you filed? (I hope you did) Go over it with a fine-tooth comb and make sure there were no typographical errors, calculation errors (i.e. - Household size) and as @OldUser mentioned above, did you send proof of your wife's citizenship or LPR?

Proof of US citizenship was provided.

All pages were provided and signed.

Her income for 2024 was 32k+ which compared to the requirement of 25,550 shows it's above and enough or so we thought, since they care about current income the most?

There are no typographical or calculation errors from what I can tell. We made sure to check other people's posts at the time to prevent making common mistakes. I really don't know what it could be?

Income appears to be the issue at first glance. Even though the required minimum is 25550, the more is the better. Depending on location, even $50k may be tough for 1 person to live on. 5 years ago I lived in a very cheap apartment that cost me close to $25K a year. If you live in area like this, there's no way you can sponsor anybody on $32K salary.

 

I would say joint sponsor is what you need.

There are no typographical or calculation errors from what I can tell. We made sure to check other people's posts at the time to prevent making common mistakes. I really don't know what it could be?

Did you send the 1040 tax return or the IRS official tax return transcript?  Is the sponsor self employed or partially using 1099 income as well as employee income ? 
What is the sponsors household size ?

I hate these really generic RFEs where you have to guess what they need. It feels like the reviewer is being lazy.
 The current income is well above the 125%.. I wondered if previous income was much lower ? That’s the only way I could see the RFE being for a joint sponsor. 

 

i see also they did send tax return transcripts. Cross that off the list.

They really are terribly unfair to the applicant… I mean you are paying for this service with your application fee, the least they could do is tell you where your supposed “deficiency” is. This one is a head scratcher as she is over the published requirement by about 25%

They require 3 most recent tax transcripts not 6 months

They sent 6 months of paystubs (which is recommended by the I-864 instructions to prove current income) and the most recent year's tax transcript which is all that is required per the I-864 instructions

Her income shown on the 2023 Tax Return Transcript was below the guidelines since we, at the time, thought we could use assets to qualify. When it turned that this could complicate things we did our best to get a better job situation for her.

 

She only has employee income.

The only thing I can now think of that we maybe should have included would be the Employment Verification Letter though the posts I read on here and the I-864 instructions themselves appeared to indicate pay stubs were more solid as evidence.

I would say joint sponsor is what you need.

I understand though our living situation is affordable for our budget. Our apartment is costing us about 12-13k a year (depending on utility rate) so we got lucky I think. Though I also understand they do not know this information since I was not asked to disclose it. 

 

A joint sponsor is indeed what we need but sadly not what we can get.
