Howdy folks,

 

I completed my medical exam in Germany last September and recently requested a copy of my DS-3025 (please find redacted copy attached).

 

I'm about to file my AOS but reading through the DS-3025 I see that no dates have been included next to the line for "covid".

 

On the day of my exam I showed the panel physician the covid certificates I had on an app on my phone. They asked me to email them over and I did. A couple of days later I received an email asking me to send over the certificates again, which I also did.

 

I can see on the second page "K Visa applicant voluntarily completed vaccination requirements" has been checked.

 

Is it neccessary for me to have a panel physician transcribe the DS-3025 and add the missing dates?

 

Fortunately there is one panel physician with availability close to me but they charge a flat fee of $500 to fill in the Form I-693. I asked whether they would just be able to complete the vaccination sections as per uscis guidance (Parts 1. - 5., 7., and 10. of Form I-693) but I did not get an encouraging answer.

 

My main concern is that this discrepency will cause a delay in the processing of my Form I-765 (Application for Employment Authorization). Ideally I would like to return to work as soon as possible. I would rather avoid spending an unnecessary $500 but it seems silly to quibble over if it means I can be employed quicker.

 

What would you do?

Submit the copy of your DS-3025 with your I-485 when you file your AOS package. This will remind them you had your medical exam abroad and are exempt from the requirement to file the I-693 with your submission. The medical exam is only relevant to the I-485 and has NO bearing on your I-765 whatsoever. Your DS-3025 says that you as a K Visa applicant voluntarily completed the vaccine requirements. USCIS doesn’t often disagree with the conclusions of the panel physician but if they do, they will just issue an RFE for a new medical and you would just go get one at that point. Again, it will have no bearing on your I-765.

No date OR blanket waiver. Your panel physician likely didn't complete your D3025 because you did not bring a physical copy of your vaccination records to your appointment.

They should have been there at your appointment.

Your DS3025 must be BOTH MARKED complete and actually complete.

Panel physician, No. Panel Physician's are abroad. Civil surgeons are in the US.

That's common. You'll need to call around and price them out. Sometimes flying to another state can be cheaper.

It definitely may as all petitions are PARALLEL. If you get an RFE for one, ALL pause until the RFE is cleared.

CS metal exams can cost up to $1k. 

That's why we (for others reading silently) ensure that our DS3025 is complete before it is included in our visa package and we use it to enter the US.

This is not correct.... a friend of Jaycel's got an RFE on her I-485 in December and two days later received approval on the I-765. Before they even had a chance to respond to the RFE.

Well for starters your panel physician is using an old form (exp 03/2020), current one is something along 12/31/2025 which is why there's no COVID on its own but listed as other. It looks complete to me. What USCIS will say is anyone's guess - hopefully RFK Jr stops this COVID nonsense soon and they stop requiring COVID for immigrants.

That is ONE EXPERIENCE, not a fact. 

There are thousands of ppl who have spoken with Ask Emma during RFE scenarios and have been advised that your timeline stalls for all as you are NOT ELIGIBLE for I765/I131 unless you are ELIGIBLE for I485.  Once the RFE response is reviewed, your process continues. 

 

Think about it as well...two days is nothing and likely they just slipped through in error.

 Could also have been a case of the work permit approval being issued before the RFE.
