Left the us without AP while on AOS on 2018. My wife got a child with another guy. What are my chances after 7 years on filing ir1 visa?

You also need to make sure you have the total story straight as to the history of the marriage as it will most likely be asked about.

@Ibama, what is the story?

Why did you leave …but most relevant why did YOU stay married when clearly the USC wife already started family with a new man?

I know 2 First Ladies are OK..but no Senegalese man would accept 2 First Gentleman.

Did you have any children during the separation?

To be successful, you will need lots of good quality evidence of the marriage relationship since the wedding date.  Do you have joint bank accounts, credit cards, health insurance, etc. over these many years?  A record of communications between the two of you?  If you decide to file an I-130 petition to start the IR-1 process, make sure you visit her in Senegal multiple times first so that you can #1 decide for yourself if you want to proceed with the relationship, and #2 build up evidence that the marriage is bona fide.

We have record of communication

Beside that she will come to Senegal in 10 days and before she leave we will file the i130. While the i130 is processing she will make another visit. Travelling is not easy.

Get your friends and family to write letters explaining your situation and that your relationship is real. Have your wife amend her tax returns. Pull together any evidence of having met in person the first time and now, as well as chat logs. Bring together photos, even if it’s photos of you guys Skyping. Make sure you’re in all insurance, if you can get on her lease (assuming she’s renting) also good.

She will amend her tax return. I got a SSN when I was working in school with F1 visa. So what financial document can I get with both of our name on it?
