Yep. Looks like he was just being a donkey for lack of a more formal, polite way to describe him.

The reason some people are advising don't travel is because there is a very real risk it could be denied while you are out of the country, because you have missed the biometrics appointment. That is the law. 

USCIS are notoriously bad with biometric rescheduling, and often if you miss an appointment they usually just deny, without sending another appointment. The onus is always on you, not them. They simply don't care - you are just a barcode to them. 

 

Legally, you are ok to re-enter the US even if it is denied while out of the country, but that is legally speaking. USCIS don't always follow the law, and CBP make the odd howler from time to time too. People are erring on the side of caution here, for your sake. 

 

 

Note that the guy you spoke to was talking rubbish. They can do it, he just didn't want to do it. They scan the barcode when you arrive, take the info, and done. Many of us here have done walk ins before or after the dates, it really doesn't matter. Try a different centre, or a day when that person isn't working perhaps. 

 

 

 

Also, please stop referring to it as an interview - it isn't. It takes about a minute, is purely procedural, and your terminology can confuse it with an actual I-751 interview for people trying to help you. 

 

 


Getting through CBP is always very anxiety-driven. Do you think I should contact an immigration lawyer in case I have issues entering?  I wouldn't go home unless it was dire. I was silly to not check my USCIS account and rely solely on an email. Lesson learnt!

I've read on quite a few other threads many other people have been denied when they don't have an interview date scheduled! If you have one scheduled they can do it. Would love to know if others on here were able to walk in with no date of reschedule!

I wish I saw this! I did everything you said except going in on a Monday. I was actually crying! My grandpa is sick at the moment and I need to go home. I told him how sorry I am and he seemed very apologetic he couldn’t help me.
 

 I will try again this week. Ive read about 10 other people’s experience on here having the same problem, that if you do not have an appointment date they can’t see you and to wait till it’s rescheduled then they can see you earlier.

This is what I heard from my lawyer who handled I-485 and I-751. That they cannot necessarily do much to help interacting with CBP. CBP won't talk to them. I heard this from a different lawyer too.

Thank you! I had a feeling about this. I guess I can only prepare my documents correctly and try my best to get my biometrics done asap.

 

CBP have always been a pain to deal with, I guess I will educate myself on my rights and hope for the best if they give me grief when I come home.

If it doesn't work out, refer to the carrier guide, and be confident when you travel back to the US.  Might want to have a lawyer's number handy, just in case.  Read again @mindthegap posts, he has years of experience, and research, to share.

A mild conspiracy type observation here…😂

but since ASC is not technically USCIS, just a vendor…it does appear they have soured on accommodating since they lost a big chunk of revenue when USCIS implemented biometric re-use.

Here’s my contingency plan and policy memo to back it up…but you need to upload to my USCIS account .

 

After you do that, STOP WORRYING and focus your energy on getting to your family. 
Worst case scenario someone on VJ will help you get past CBP 😂…yes @mindthegap is that good !

‘I have additionally presented myself in person to ASC location on xyz date and was refused . I confess I almost cried ( OR GO AGRESSSIVE but add some emotion evoking bit ) 

 

Unforeseen family medical emergency require me to travel out of the country on xyz .
My anticipated return date is ( date), and I hereby request my appointment be rescheduled for ( date ) or after. 
‘The urgency is my beloved grandfather is critically ill and I will be able to supplement this request with doctor/hospital records should it be deemed necessary.

Add your favorite foto of you and grandpa and copy of airline tickets for last trip (nif any )nand this current trip

2. Occasionally check your USCIS account online, but don’t obsess , you will be fine .
