I have received an I-797 Notice of Action stating they have extended my green card for 48 months on November 11th.

 

I received a letter regarding my biometric interview on December 31st, 2024. However, I was in California and received the letter once I returned to Florida. I never got an email regarding the interview schedule, so I missed the interview as i was on a flight home that day.

 

I called today to reschedule, and he said that if USCIS believes I haven't abandoned my case they will reschedule an interview in 30 days and I leave the country back to Australia in 2 weeks for 3 weeks!

 

Will I be able to re-enter America when I return? Gives me so much anxiety after the nightmare I had getting into the country almost 2 years ago!

I will be traveling back on a EXPIRED Greencard and my Notice i-797. Will i need to bring anything else if my Biometrics is not scheduled before i leave?

I would have an expired GC & Valid Passport, that is common sense when traveling international!

Do a walk-in. Now. Tomorrow. Monday. First thing, last thing, whenever, just do it as soon as possible, and definitely do it before you leave the country.

Take your appointment letter as it has a barcode the need to scan. You can't do a walk in without an appointment, but you can - at their discretion - do it with an appointment on a different date. source: done it  myself multiple times. 

 

If you don't they will - in all probability - issue a denial, as per policy. Don't take everything USCIS tell you as gospel - they lie (frequently), and are also wrong (frequently) about their own policy, and the law. 

Yes, yes, you can refile if denied, but it is a pain in the butt as you still have the prior denial to deal with concurrently (as I know only too well).

 

Yes, you can board a flight to & re-enter the US with your expired card AND the extension letter/receipt.

You are, and remain, a permanent resident, and have a valid 48 month extension letter to accompany your expired card. 

 

 

 

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Your first post wasn't very clear. If you had said I have my expiring green card and original 48 months extension letter, I would have answered differently. You said "extended 10 years pending biometrics ". A 2 year green card is either extended or not.  I have seen the extension letters frequently in my line of work and the letters are very clear.

I have read several experiences from people who tried to schedule new appointments and never received a notification about a new appointment, so I would definitely try to do a walk-in. Bring your original interview letter and explain that you were out of state and did not know about your appointment. Hopefully they will be able to do your biometrics. You don't want to get denied while you are out of the country.

My wife travelled and reentered twice using the extension letter and an expired Green Card. But you need to get the biometrics figured out before you leave. At least I would.

You can definitely re-enter with the expired green card, valid extension letter, and valid passport. We did it multiple times. But as others suggested, I would try to do a walk in for Biometrics. And definitely be prepared to wait until someone no shows.

I did two walk-in biometric appointments for my two greencards, worked like a charm. I just had to wait a little because they were busy in the morning - I recommend that you try in the afternoon.

Not to scold you or anything, but pretty much nothing going on in the next week will be more important than getting your biometrics sorted out. You’re stuck in an urgent time frame and your immigration status/applications are not something to get complacent about. Not saying you are, but I don’t think anyone would advise waiting a week to address this given the dates you’ve given.
