Hi there,

We are filling out the I-864. I am a student overseas. My income doesn't meet the 125% of poverty guidelines, and actually I am finishing in a couple of months. So we are going to rely on our assets to meet the guidelines. Do we need to include bank statements with the form? Do I report my income from scholarships even though it is ending? Since my husband's job is ending (he has one lined up for the US when we get there) do I include his income?

Liz,

You need to document the value of those assets appropriately, show that they can be converted into cash within 1 year, and that the cash or the assets themselves can be brought to the USA. Bank statements would be one appropriate way to document bank accounts.

It won't hurt to indicate that your husband has a job waiting for him in the USA, nor will it help. It cannot be considered in evaluating the I-864.

I would complete the I-864 showing current income on the date of signature. On that basis, I don't see anything wrong with using any form of current "income" but they are unlikely to consider it as sustainable in the USA unless it actually will be.

Yodrak answered about the bank statements. I take it you are aware that three dollars of assets are needed to replace one dollar of income?

Thank you very much Yodrak and Pushbrk. I think I understand how to move forward. Yes, we understand the requirements for assets. Ours are liquid and enough to meet the requirement. I hope that the bank statements will be enough proof--now we just have to track them down.
