My mother in law filed a petition for her unmarried daughter and son last 2016. My in law was a green card holder that time. My sister in law is currently pregnant but is unmarried with her boyfriend. My question is, will she be able to bring the baby here in the usa? And how will she be able to bring her partner as well?

Child yes, non married partner no.

She will have to marry him and once she’s here with a GC, she can petition him as spouse of LPR.   Will take many years.

Last question though it might sound stupid. Which last name the baby should use wheb he/she gets born? My sister in law or the partner

It doesn’t matter at all, for the purpose of U.S. immigration.

Best case- she should marry her partner after coming to the US with her immigrant visa and then petition for him. Is your sister-in-law from Philippines?

And just to clarify, her mother is now a citizen? She’s still got many years to go then, her partner might also want to look to see if he could get to the US in his own merits in that time, i.e. an employment based visa. 
 

The only other option (if MIL is a citizen) is for them to get married, but that will increase the wait even further. So they need to decide if they want to wait longer but be together, or be separated for several years.

MIL is now a US citizen/dual.

@gwafuh_rnIf she doesn't marry, she'll have two categories in her favor both F1 and F2B, whichever comes first. Still ways away but something to be aware of. They should decide what works best for them nonetheless.
