I am permanent resident (from Germany, submitted N-400 in October 2024) sponsoring my husband who is from Colombia. We submitted I-130 and I-485 in January of 2022. Our I-130 was approved in July 2023. Interview appears to have been waived and we have been in the final case decision stage for four months now. According to my check on USCIS website, we are still within normal processing times until March 2025 (Chicago field office). 

 

My husband has a an excellent job prospect, but it requires that he is a permanent resident, and we are nervous about the new administration coming in. Can we ask our Congresswoman to check with USCIS now or should we wait until we fall out of the normal processing time?

It looks like Jan 2022 is just becoming current right now for the F2A, so the hold up could be the hold up.  Also, AOS interview waivers sometimes takes longer than couples that have interviews.

How did he submit his I-485 in January 2022 when the category wasn’t current? Is that a typo?

 

Just checking he’s been in status throughout the process? What visa has he been on?

Right.  Concurrent filing doesn't make sense to me, either.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Unless your PD date is Jan 01, 2022 then just wait it out as any other Jan date means visa still not available, so processing time is irrelevant and  I-485 expedite request won’t be considered.

 

 

As long as your husband was in status at the time he applied for I-485 and F-2A was current, you have nothing to worry about. 
 

No matter how swift new administration implements changes, any drastic steps would likely affect future applicants and have a future start date…(example eliminating the 2 visa bulletin charts )

 

I think you will naturalize before the Visa Bulletin gets revamped anyway. ..see if you have any qualifying expedite criteria to nudge your N-400 .

That meant the spouses and unmarried children of lawful permanent residents (LPR) could file for adjustment of status if they had been inspected and admitted or paroled on their last entry and had always maintained lawful immigration status, including not having worked without authorization, at the time they filed the Form I-485.

Thank you all for your responses! The visa bulletin was current when we filed (I don’t remember the exact date of filing, but I remember it was current), therefore the concurrent filing. My husband was still on a visa when we filed, so he never fell out of status. He has his AP document (and has traveled with no problems) and EAD
 

We have been seeing a lot of fast approvals lately (within a year of filing) which is why we thought it might be worthwhile to have our congresswoman check in, but there is nothing that we can think of that could jeopardize his approval. It has just been a long time and my husband is starting to get depressed and worried because his “career job” requires a green card. 
 

I will look into possibly expediting my N-400, thank you!

Fast approvals were a minority and for spouses of US citizens.

 

Expect things to slow down, including N-400, as elections are over.

 

Realistically, not much will probably happen until second half of 2025.

Ah, ok. I would look at your Priority Date and just make 100% it was current when the I-485 was filed, it’ll only take 5 minutes for you to look it up but it could have a HUGE impact!

So an EAD card won't work for this job prospect? What job is it? Did he file for EAD?

to not confuse other LPR , u have all the rights under the Constitution but u r not yet a citizen

 

    • The House of Representatives: Represents citizens based on the population of their district, with each state having at least one representative. 
       
    • The Senate: Represents citizens equally by state, with each state having two senators. 
       
  • The first three words of the Constitution
    The Constitution's first three words, "We the People", affirm that the government serves its citizens. 
     
    And they have no power over the immigration process except to write laws
