I was trying to locate some information about the police certificae and came across this:

Do not attempt to obtain police certificates covering residence in any of the following countries, as they are not available:

Afghanistan, Ghana, Malaysia, Sudan, Angola Guatemala, Mexico, Syria, Azerbaijan, Haiti

Mongolia, Tajikistan, Bangladesh, Honduras, Nepal, Thailand, Bulgaria, Indonesia, Nicaragua

Turkey, Cambodia, Iran, Pakistan, USA, Chad, Iraq, Saudi Arabia, Uzbekistan, Colombia

Kazakhstan, Sierra Leone, Venezuela, Costa Rica, Laos, Somalia, Vietnam, Equatorial Guinea, Libya, Sri Lanka

As you can see Vietnam is on a list of places to not to attempt to obtain a police certificate. Is this true? If not, can some one please tell me where does my fiancee get the actual paper that the police will fill out? Do they have it at the police station, or is it inside packet 3?

If you can tell us where you find that list, it would be helpful. You do need a police certificate for Vietnam. They have been required since forever. You get the certificate at the department of justice at the provincial level, or if you live in HCMC, at the city level.

That list might be the list of places where non-resident can not obtain a police certificate from. But any residents of Vietnam who apply for a visa will require a police certificate.

I think the police certificate is called the " Ho Khau " in vietnamese. My fiancee was able to get hers about 2 months ago.

It's not the Ho Khau. That's the household registration book. The police certificate is called "Ly Lich Tu Phap".

It took my wife 6 weeks to obtain a police certificate.

Available.

Residents: Requests for a "Justice Record Check" (Phieu Ly Lich Tu Phap) are made at the Department of Justice office in an individual's district or official residence. The official residence is that registered in the "household registry" (Ho Khau) issued by the district police. There is a fee. The record check takes approximately three weeks to complete. The record check must be initiated in the district listed in the household registry as the citizen's official residence.

I believe there is a mix-up on the issue. The list of countries here represent the ones whom will not issue a Police Certificate of Lack of Criminal Records (PC) to a foreign national.

For example: If you are an English man, who worked and lived, this case the country is Vietnam. Later in life, you meet an American woman, and decide to engage to her and apply for K-1 Visa. You, the English man will not be required to obtain a PC from such countries, included Vietnam when applying for a K-1 Visa.

This section will not apply for Mike's fiance. She is a Vietnam national, she will be able to obtain a PC from her local police department. It is a must have for ALL vietnamese who applies for Visa to come to the US.

My wife Kim, lived and studied in Japan for 8 years. HCMC required a PC from Japan before they issue her Visa. This was in addition of the Vietnam local police certificate of lack of criminal records.
