Hello everyone,

 

My I-485 was denied because of the below reason:

 

"Based on the documents submitted, we could not determine that the petitioning sponsor and
the petitioning sponsor's household member(s) listed on Form I-864, Affidavit of Support, are qualified. In
order to be qualified, the petitioning sponsor's Form I-864 must be properly completed and signed, and the
supporting documents must establish that the combined income of the petitioning sponsor and the petitioning
sponsor's household member(s) meets 125 percent (100 percent if military) of the federal poverty guideline for
the sponsor’s household size"

 

 

Can I refile the form I-485 since I am within the 33-day period? If I have to refile the I-485, do I need to do another medical exam? The last medical exam was in March this year. Than you!

Yes, you can re-file the I485.  Make sure you clear up the I864 issues.  As to the medical, you may need a new one, but I am not sure.

You definitely need to attach medical exam results in sealed envelope with I-485 filing. There's new rule saying packet will be rejected if you don't submit I-693.

 

Medicals are good for 2 years but I'm sure you sent sealed medical with previous I-485? So you can ask civil surgeon whether he can produce another one of those envelopes, but I'm pretty sure they'd want to charge you for full medical again.
