Hello Everyone,

 

Asking for a friend

 

my friend (23F) came to california 6 months ago with her mom. The grandma petitioned the mom and from my understanding my friend was automatically added to the petition. The thing is my friend has a 1 yr old daughter that she left behind back home. She thought she was able to being her child with her because her mom said the 1 yr old has been added to petition. but comes the interview the kid does not have her own documents. 

 

so does she need to file her own I-130 for her kid? if yes, how long does it take?

I agree with @EmilyW, it is best for your friend to join and clarify their situation.  What visa was your friend’s mother looking for, F2B, F3, etc.?  How old is your friend, and have they aged out?  When was the I130 approved for the mother?  Those are just some of the pertinent questions that need answering.

As recommended ask your friend to sign up.

Though, I think I understand the situation; correct me if I'm wrong. Your friend was a derivative beneficiary on a petition filed by her grandmom for her mom. She 'presumably' was single and qualified with CSPA and successfully got her visa along with her mom. Your friend couldn't bring her own child because the petition does not allow derivative grandkids of the primary beneficiary. Your friend has to file I-130 petition for her child; a visa number will be available in about 3 years based on current visa bulletin projection.

Then yes, she needs to petition her daughter. It'll be at least 4 years or so for the whole process unless the Visa Bulletin speeds up, she should petition her asap. Partly so she's in line as early as possible, but also because Trump has talked about ending chain migration, so best to get an application in ahead of 20th Jan just in case things change.

She should also research the I131 re-entry permit if she wants to return for an extended period of time to raise her child.
