Long story short, Got a CR1 case pending at the Embassy for a little over 2 years now. In the process of waiting, my husband who is the beneficiary has an affair with a young lady that just had a child for him. I was shocked, heart broken but at the same time happy. I would like to withdraw the petition and have the case dismissed or closed. Please help

You need to contact the embassy/consulate right now to withdraw the case. I mean RIGHT NOW.

 

What's the embassy?

 

Also, why is it pending that long at the embassy and not NVC?

Ok. Then I don't think it's at the consulate; it's still sitting at NVC.

 

However, since you aren't sure where the case is, I will advice you contact both NVC and the consulate and state that you are withdrawing your I-864. 

 

And additionally, probably not necessary but also contact USCIS after successfully withdrawing the I864 to withdraw the I130 since you also signed that form.

For USCIS, you'll write to the service center that approved the case, that you want to withdraw/terminate the approved I130 after you've successfully withdrawn your I-864 from NVC/Consulate.

Another shameless plug, since the case has been sitting for 2+ years waiting for an interview, when he is finally scheduled for an interview the consulate would most likely request an entirely new affidavit of support I864 and financial documents. Here is where you would refuse to provide him the new documents. If the consulate doesn't receive those updated affidavit of support documents they will eventually deny the visa.

Hmm, the support email is actually their newer email listed on the state website. You are sure you typed it correctly?
