Long story short; my fiancé had her interview earlier this month (Dec 3) and the officer said she passed the interview, but she would still need to submit one of the missing forms*. My fiancé got the new form and went back to the OFC (same-day) to submit it. They sent us an email at the same time to say it would delivered to the embassy within 1 business day (Dec 4).

 

On USVisaScheduling website, it says 'Delivered to Post' for Passport Status and on the CEAC website it says 'REFUSED', which was last updated on Dec 10. I am freaking out because I know usually refusals mean either you start over or you get an attorney, but it also mentions that during administrative processing it will say 'REFUSED'.

 

 

*The missing form was a National Bureau of Investigation (NBI) Clearance. We originally brought the police clearance (white form), but they requested it be the blue form. Additionally, there is nothing on the clearance, so that shouldn't be a reason for a refusal.

Everyone I've seen on 'Administrative Processing' said they received a formal email/letter telling them about the missing documentation, but we never received that other than the verbal comment from the consulate officer.

the longer AP does depend on the Consulate and may have nothing to do with missing documents.

Right, but how do you know if you are in AP? That's the part that is stressing me out because it has been 2 weeks and we haven't been given either a notice for AP or notice for refused, which both statuses are supposed to be given within instructions from the consulate.

I ask that question because when they need a document from the interviewee, it is considered “Refused” under section 221g until that document is given to the consular section. So it’s not surprising that the CEAC status shows Refused

Well unfortunately I already scheduled a big visit in January, so what are the chances it'll be resolved/delivered before January 24?

 

PS: I know I was dumb to book everything already, but I thought it was approved and we were just waiting for it to be delivered, so I was like, surely it'll be delivered within almost 2 months.

Refused doesn't mean denied. Denied means denied. 

 

This is what happens when you're in AP. It will change to approved once they're happy, and then shortly after that it will change to issued.

CEAC has added the status “Refused” in addition to “Administrative Processing” to indicate an application that cannot be approved yet, and is essentially sitting and waiting for more attention.  As @smilingstone stated, “Refused” does not mean “Denied/Rejected”, all you can do is wait for movement which may take a bit longer during the end of year holidays/vacations.
