Hello VJ,

 

A friend's husband had his ir/cr1 interview today and was missing a document (stating no court records). The interview was short, about 10 minutes. They told him to mail the missing document, but they didn't keep his passport.

How would you interpret this?

They've been together for years, married over 2. She is 20ish years older than him. 

He was on a work visa in the U. S. a while back and after coming back to his home country, he quit that job so his visa was revoked for that reason, but on the DS form he said he hasn't had his visa revoked before, thinking the question was more about the visa being revoked due to him doing something wrong/bad.

 

What are your thoughts on this?

Was he given a piece of paper and if so, what did it say? Sounds like he's being put in to AP, there are a few issues they need to check out.

I understand their case has the age gap red flag, but their relationship is genuine, they talk all day every day, his family loves her, hers loves him as well. But the c.o. didn't ask for any proof of relationship etc, just asked him some basic questions.

Why did he not adjust?

He was here on a work visa, they met here and started dating, lived together. Then his contract ended and he went back home. At that time they hadn't decided yet which way they were going to go. After that, she visited him in Bosnia, they got married and started the spouse visa 9-10 months later.

 

The petition took 14-15 months and now this.

He just told me they did give him 221g for the missing document.

But still we're confused why they didn't keep the passport.

Your friend will need to wait out the AP process 

 

there is no way to speed the AP but 1 thing that the embassy can do it require a new interview ( and medical if over 6 months)

 

And they can also ask for passport to be sent to embassy if they have decided to approve

 

 hope the case is not returned to US with a NOIR or NOID

If returned the USC has to answer all the objections the CO had with actual proof of the validity of the relationship from the USC 

the CO will not mention the age difference but that is the main reason a CO is concerned.

Thank you. I think my main concern for them was that the fact that they gave him the passport back, thinking that it could automatically mean the visa was going to be denied.

They didn't keep any of the documents that were requested. The medical, vaccination records, passport photos, etc.

Not automatically, it could mean that but probably just means he's been put in to AP so they give it back to him whilst they do their checks.

That is definitely a concern, too. So the missing document isn't a big deal, but what concerns me is that they didn't keep anything that he brought to the interview. I don't think they even kept the medical records. 

The wife is a really good friend of mine and I want to stay positive for her, so I just wanted to see if anyone has had a similar experience and what the outcome was in their care.
