Hi everyone,

 

I'm an Iranian-Canadian dual citizen, and my EB2 NIW petition has been approved, but my priority date is not yet current. I’m trying to plan ahead and have a few questions, particularly for my Persian/Iranian friends:

 

  1. For Iranian nationals, how likely is it to be placed under Administrative Processing? Is it almost guaranteed, or are there cases where it doesn’t happen? Would holding dual Canadian citizenship have any impact on this?
  2. Additionally, how do you think the likelihood of AP might change depending on the embassy location (e.g., Ankara, Dubai, or Yerevan)?
  3. Finally, for Iranians who have undergone DS-5535, what is the average time to receive clearance?

I’d really appreciate any insights. Thanks for your help!

I think right now it is almost certain that you'd be put on AP regardless of the embassy location but nobody can know for sure and things may change in the future. As far as I know, dual citizenship may help you escape a potential travel ban but not AP. AP length can also vary greatly case by case and there is no way to predict how long each case is going to be in AP.

When I go to the AIS website to print the address sticker and barcode, I can’t see the option. Can anyone please tell me how to do this process because I have already made my account there before my interview with them. Can anyone please tell me how to contact the AIS in case something is not working. Please someone reply me.

Hello everyone,

I married my husband around 3 years ago. He's American, I'm Iranian living in Canada and I have Canadian PR. Haven't traveled to Iran in almost 7 years.
I had my interview on Feb 4th, 2025. I was refused under Section 221 (g). In the paper they gave me, it says that I have to fill out a form following a link. It's obviously an online form.
I remember that the officer told me to copy and paste my answers to a word document, print it and send it to the Consulate General of the USA in Montreal.
Have you had this experience?
Should I fill out the form online and then send another copy to the consulate?
I'm so confused. Can anyone please help me?

I had the same experience. You need to fill out the form online and submit it. However, it would be much more efficient to prepare your answers in a Word (doc) file, and then email the completed form to "Montreal-IV-DV@state.gov."

If you are male, there is a 99% chance you will be placed under Administrative Processing (AP), regardless of whether you have an exemption card or have completed military service.

Selecting Ankara, Dubai, or Yerevan could be challenging, as you will need to travel to these countries for your interview, and then mail your passport there to have the visa stamped. It’s ultimately your decision, but I believe it will be difficult.

No one can predict the exact processing time, but it typically takes about 6 months.  II think that the officer consider your country of birth, but having a Canadian passport could help expedite the AP wait time.

It was 1 month ago, so not sure how long it'll take, but you will almost certainly be put in AP. Not sure if changing the consulate matters. Plus, I don't think you can just pick and choose. You gotta choose where you resdie.

I will share a detailed list in a few days, when i get my packet.   I am under ir1 visa.    Interview june20 2024,   ds 5535  same day.    I did use congresman,   i went through the lawyer route from the very start due to arrest record, and did not use WOM.      Likely was put in ds5535 due to multiple reason, so hard to say why.   Drug addict brother with similar name,   he stole my sin so i had two names on my cra, my arrest   and a few other things probably, nothing serious or deflecting on me, just all kinds of things to be generally cautious on.
