Hello. 
 

I’ve come across several posts about mandamus lawsuits, especially for those stuck in administrative processing (AP).
 

For those of us waiting for a consulate interview, is it common to file a mandamus to compel the consulate or Department of State (DoS) to schedule the interview?

 

CR1/IR1 visa.

It is not common but if your case is well beyond the normal processing times then it is an option

I know CDJ is heavily backlogged, you can check to see how long others have been waiting.

@Boiler Yeah, I’ve seen that Ciudad Juárez has a huge backlog. I’ve been looking around, but it’s tough to get a clear idea since wait times seem to vary so much.

Seems to be about a year long wait on average. The ones with shorter wait are probably expedite requests.

Not unless there's an issue/error i.e. you've been missed for some reason and people who were DQ'ed well in the same category after you have got interview dates. If you're just waiting your turn, then a WOM isn't going to help you jump the line and it'll just be dismissed.

no, this site is free / if u want immigration attorney,  make a consultation appointment

and check out some timelines on here.  i applied 1st 2009 and finally got successful interview in 2015

 

but if u go to one to do a WOM ,  he /she will tell u its too early

U r not past the timeframe of waiting for interview

 

WOM are not always a success/  force a decision on immigration  and it could be denial/  seen that happen from posts on here

U r in queue like so many others /its stand in line and wait/  that is not rude its just what  we all have to do

 

wishing u success and a prayer for a good life here in  US

@JeanneAdil thanks for your response. Regarding "force a decision on immigration  and it could be denial/  seen that happen from posts on here"..... what do you mean by that? Is that for WoM for folks placed in AP?

Hopefully a lawyer would not take your money but if they did even in 3 months you are well within processing time so an easy explanation to the Judge and you are 5k down

@Boiler That's a fair point, but what really is the definition of 'well within processing time' when the consulate keeps shifting the goalposts? Without publicly available timelines, it feels like there's no clear standard to go by.

@SalishSea not really trying to jump in front of anyone, just trying to understand what options are available when there's no transparency around timelines. If delays are indefinite, it feels like there's no other way to move things forward.
