Hello, everyone!

 

Besides the 1040, IRS Tax transcripts, W2 and certification of employement letter, etc. I need to bring supporting documents to show the joint sponsor is a US citizen. I was wondering if the driver's licence will do or it's the birth certificate that needs to be presented. He's got no passport or greencard.

Either (not both):

1. A COMPLETE federal tax return copy including all pages and schedules AND earnings statements such as W2s and/or 1099s. A 1040 is not a complete tax return. 

OR (not and)

2. A Tax Return Transcript (AND earnings statements ONLY if the sponsor filed taxes as MFJ and they need to prove their INDIVIDUAL income from that of their spouse’s).

Is only needed when you put employment income instead of tax reported income as current income on the I864. EVLs should be accompanied by 6 months of current paystubs too.

A DL does not prove US citizenship. 

Non resident aliens can drive with US drivers licenses/ you don't have to be a citizen to drive. 

A US BC, PassPort or Naturalization Certificate proves US Citizenship.

Are you referring to a K1 AOS interview? Your interview letter will indicate documents needed for the applicant, the sponsor and any joint sponsors.

Then BC is the only option. But US domicile is equally important.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

How would a drivers license be evidence of citizenship?

Right, I don’t think they could be.   I may be wrong, but I think LPRs/noncitizens can get them in some states.

My mother in law has a Nebraska State ID card with a Real-ID star in the corner.  She had to show them her green card and her Indonesian passport.

 

When my wife got her Arkansas driver's license, they put the Real-ID indicator on it but gave it an expiration date equal to the date her green card expired.  We had the license re-issued after she naturalized.

 

My experience is that LPRs can get the "enhanced drivers' licenses" also.

Wife got a real ID DL in Texas as LPR (CR-1).  6 year expiration.

Real IDs can be obtained by anybody including LPRs and foreign students etc. Enhanced DLs and Real IDs are different things though. Don't want to side track the thread any further, but it's an interesting discussion. Maybe will start a different thread elsewhere.

Oh, I see what you're saying!  Here in Washington, EDLs are only available to USCs, because Washington state residents are eligible for regular DLs without regard to immigration status.  I just assumed it was different in other states.
