Hi all

im a US citizen and i and my gf are planning to get married in Summer of 25’. She was an international student and has an F1 visa, and recently got her EAD card as part of her stem OPT and she works full time.

 

knowing that Trump is President Elected. Will his policies affect us citizens marrying non-citizens as well? Will it affect AOS too? I realize illegals immigrants who overstayed their visas can also marry US citizens but my gf has a valid F1 visa, EAD card etc. should i be worried too?

Nobody knows for sure, but most likely your GF is going to be OK as long as she maintains status and files I-485 on time.

 

It's possible the in-person interviews are going to be required for most AOS applicants, like they were before COVID. Things may get more strict in terms of forms, following the process correctly. Already, you see USCIS saying they'll reject I-485 if no I-693 is provided, whereas in the past RFE was issued. So if you're sponsoring, make sure you have all valid documentation for taxes you filed and income you have. Find a joint sponsor sooner than later if you can't qualify on your own.

 

Things like that... I wouldn't think aliens in status will be affected much. But again, all of this is speculation.

No.  There has been no mention of effects on people lawfully present in the US.  I would not advise anyone to let his/her legal status lapse.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

A loud YES …your F-1 /OPT girlfriend w an I-765 has every reason to worry. You may want to reconsider your plans…while the process is still smooth and speedy.

in that case what should we do? Her company is applying for her H1B in coming year. But hopefully by summer 25’, i want to apply for I130 and I485

There is absolutely no way to know.  Next president doesn't take office until January 2025 and he is somewhat of a wild card.  Honestly there is no telling what he will do.  Could be a complete nothingburger, or he could shut the border down.  You can't worry about things you can't control.

 

I wouldn't recommend anyone rush a dating relationship they aren't ready to formalize, but if I knew I wanted to marry this person, I would go ahead and do it.  You can have a civil union now and a church ceremony in the future.  This is what I did with my partner.  A relative by marriage has superior standing over almost any other type of immigrant.  

 

But anyone who tells you yes or no is just speculating.  

I admit I was somewhat apprehensive about how our immigration system is going to change last month, but I quickly realized it's futile to worry about things you cannot control.

This was your original question.  There is no indication, imo, to worry about her being able to adjust status after President Trump takes office. In fact, Trump has talked about Green Cards for those foreign students educated in the US.
