Hello,

 

My ROC was approved the same day my N400 interview was scheduled on December 4. My interview is scheduled on Jan 16, where I was suppose to be in Mexico for a trip. I’m obviously coming back to the states and my idea was to go back to Mexico after my interview. My question is, if my ROC has been approved does my husband have to come back to the states with me? This is for the 3 year rule N400. I’m trying to see if I can avoid a round trip for my husband if not necessary. Posted pictures for the people who are curious

Trip is planned and its other people as well. It has been decided that my husband and I will come back and go. Thank you for the input

At my wifes interview, the officer called her name from across the very full waiting room and as she walked up he greeted her and introduced himself and then asked her if I was......"and said my first and middle name".  She answered "yes" and he said "good" and then took her back to her interview.  He never said a word to me directly and I only sat around in the waiting room but my presence was definitely noted and it was clear he had reviewed her case in advance and knew exactly who I was.

  • August 31, 2021: Stepdaughter Documentarily Qualified by NVC
  • September 15, 2021: Received Interview Date from NVC, October 05, 2021
  • September 22, 2021: Passed physicals at Saint Luke's Extension Clinic
  • October 05, 2021: Interview at US Embassy Manila. Verbally approved by US Consul. Positive interview experience.
  • October 05, 2021: CEAC status changed to "Issued"
  • October 07, 2021: Passports tracking for delivery on 2GO Courier website
  • October 08, 2021: Passports with visas delivered.  "Visas on hand"
  • October 08, 2021: Paid Immigrant Fee
  • October 12, 2021: Temporary CFO Certificates Received
  • October 26, 2021 POE arrival at LAX
  • November 02, 2021 Social Security Cards arrive in mail
  • January 31, 2022: USCIS Status changed to "Card Is Being Produced"
  • February 04, 2022: USCIS Status changed to "Card Was Mailed To Me"
  • February 07, 2022: Green cards received.

My SO was at work and I took a couple hours off and went to my interview alone. We went together to my AOS interview, ROC was approved without an interview. I don't even think the officer asked where my spouse was during the N400 interview.

 

We sent in a bunch of documents shared accounts, insurance, loan etc.

 

I think it is totally up to you to make the decision and in case they were looking for him, then it is on you. We can't make this decision for you, you have to decide and take responsibility. Worst case you could explain and bring proof that the two of you are in vacation and you flew back to do the interview (boarding passes, itinerary etc)

 

I don't remember the interview letter stating that i need to bring my SO

OP's future interviewer may be different to your interviewer. There's been definitely cases when USCIS needed to see US citizen spouse. I wouldn't risk entire immigration and bring the spouse

Yes, typically they don't need you.

I noticed the following patterns though :

- You bring spouse => they're not needed

- You don't bring spouse => some officers get worked up and ask where the spouse is

- You bring extra evidence => nobody cares

- You don't bring extra evidence => officer asks for it
