6 months is not that long for extended AP.  Filing a WOM is a bit risky.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hello everyone 

Is there anyone here who had in The US embassy 🇬🇪 immigrant visa interview end of the May 2024 and received 221G refusal letter, reason is case undergoing administrative process. 
Could you share your timeline and if you consider write of mandamus lawsuit for unreasonable delay process.

Depends on the Consulate.

It's not an unreasonable delay yet, far too early for WOM.

Interview had end of the May, 2024. (IB1 Visa). The US embassy Georgia.

I think normally time is to complete AP 6 months. I can’t believe if someone working on my case and can’t complete the process. Also, I don’t wanna to believe they need 6 or 8 months to make a negative decision.

There is no 'normal' time for AP, it often takes much longer than 6 months. It's not just them making a decision in that time, it's them gathering background information and that often relies on third parties i.e. if they're doing background checks in other countries, those other countries can take months to respond. 

 

Do you mean IR1 or EB1?

 Visa IB1. 
approximately when I can sue? I know when you file wom maximum 4 months you will get a decision🤷‍♂️. If DOS or US Embassy isn’t ready to make a decision they will get from court additional time to complete the administrative process 🤷‍♂️.

You could use now, the issue is if it makes sense to sue now.

 

Obviously a subjective call.

If it's IB1 then are you adjusting? That's a more complex route so I'm not surprised it's taking longer.

 

As Boiler said, you can file anytime you want. It is just likely to be a waste of money if you file too early and get it dismissed.

I also worry, will not waste money. My opinion is if they would like to make a negative decision, they will make it in 6,8 months, year or two years! For example: If I will wait a year or two years I think it’s not guaranteed to get approval note.

From the court. And it can still take a year or two, but the visa be granted. Again, it's not the decision that takes this long, it's the background checks that have to be completed to get to the point where they can actually make a decision. They just need time to go through the process.

Believe what you want, I've seen cases in AP for 2+ years. It is far too early for WoM, you will be forcing them to make a decision and if they aren't done with all the background checks for AP, you'll end up being denied.

To be honest, sometimes thinking to get bad news if it will be timely. I faced serious hardship to waiting this process! 
I think this process means they don’t like people and would not like to receive legal people!
