USCIS games-i290b returned

I have no idea what is going on at the USCIS offices but its clear to me they are completely inefficient workers.

We filed i290b after USCIS claimed missing information related to i864-untrue.

My husband spend around 2hrs+ on putting together evidence and explanation of their error along with i290b

 

Guess what they done? Returned the entire package stating-"one or more of the following fields were not completed"

-information about the appeal or motion

 

1.There is no such field

2.The form was filled out in its entirety

3.98 pages of supporting documents was also sent

 

What is the script at this totally inept government institution?

I think its time they hired monkeys.

There is, I think they mean Part 2. Which boxes did you complete in that section?

Can you post a (redacted) copy of Parts 2 and 3 of your I-290B? It sounds like your information there is insufficient.

I agree. I normally tend to tell people that the immigration process is pretty straightforward and easy, but looking at OP's history there seem to have been several issues that they were unable to resolve. A professional looking at things may be what is needed here.

Part 3 MUST be filled out

Part 7 is only additional space 

 

We will have a professional involved to lodge a complaint against USCIS for continual error-yes. Correct.

No, we did not use it

Its also stated you can attach a brief, so that was what we done.

Along with Part 3 Basis for the Appeal or Motion.


No, Part 2 - which is the ‘Information About The Appeal or Motion’ section they have said is incomplete. 
 

As above, if you can provide a redacted version then people can help work out where the error is.

Instead of filing a complaint, it might be useful to thoroughly review what you submitted because there's obviously something missing or unclear in what you provided. 

 

With USCIS, you have to be very clear and spell things out for them. If you overwhelmed them with too many documents, they probably could not find what was really needed in the pile of fluff.

1-C

2-B

3-I485

4-(receipt no entered)

5-empty (not applicable)

That's why it's been rejected. You should have filled out either 1 (for an appeal) or 2 (for a motion), not both. 

 

As it says at the top of that section: "Please indicate whether you are filing an appeal to the Administrative Appeals Office (AAO) or a motion. You cannot file both an appeal and a motion on a single form. If you select both an appeal and a motion, we may dismiss or reject your filing."

We didnt select both, both would be 2C

It seems the only remaining issue can be with 5-immigrant or non immigrant classification.

We have never been given, or had to fill this out at any other point in the entire process so had no idea I had one. 
oh well. Thatll be the end of the green card journey!

No, 2C is for a motion to reopen and a motion to reconsider, not for a motion and an appeal. Section 1 is for appeals, section 2 is for motions, you've selected one from each so they don't know what you're asking for - and as the instructions say, will result in a rejection.

 

I'm really sorry but this isn't USCIS's error from what you've said. Don't give up, it's absolutely fixable but I agree with the above, I think I'd get a lawyer to check it all over and see if filing another correct I-290B is the right thing to do, or if there was an error with your first filing so you need to resubmit that instead.

P.S. For the immigrant classification, here is the list. I'm not sure what you're filing for but hopefully it helps if you do refile the I-290B.

Yes, you need to leave section 1 empty if you're filing a motion rather than an appeal. And presumably should have been 2C rather than 2B? But hard to know for sure without knowing details, I'm not sure what you're filing for.
