That would be for an overstay beyond 1 year, there was a 5 year ban for the deportation and as I did not get an answer I assumed other issues.

 

I find the UK situation particularly interesting, probably not relevant for a Tourist Visa

I reported it to the UK immigration and they were very upset that I did not invite them to the wedding.

I don’t think you are reading my posts carefully. I DO NOT WANT TO IMMIGRATE TO US. I work for one of largest tech companies in a senior position and other than getting paid more than I need, I get a chance to self actualise myself. All I want is to be able to visit my wife when she is in distress and help her as much as I can.

History is a good predictor for people who are static and do not improve. I exert myself everyday to improve morally, cognitively and spiritually. I was very young when I went to the US and made mistakes but I think I paid a price much higher than my follies. At this point in my life and career, US cannot give me anything other than a chance to help someone whom I love and care for.

Your first post in this thread says 'my question is if I can apply for a non-immigrant visa to go see her at least or in the best case scenario get an immigrant visa based on our valid marriage'. So you raised the question about an immigrant visa, people are only responding to the info you've given.

There are a lot of red flags in your case. 

 

1)  Why is your profile country Burkina Faso when you stated you married your second wife in your home country (India)?

2)  You refer to your first wife as "my wife" when you moved on from that relationship, married someone else, had children, set up a life in the UK, and gained UK citizenship.  In most cases people would refer to the person as "my first wife" rather than a more familial "my wife".  

3)  What happened to your first wife in the years since she was going to divorce you?  Did she re-marry?  Did she have a family with someone else? It seems you only kept up your relationship with your first wife until your attempts at immigration through her failed.  And now when you see a possible chance you can immigrate through her, you are all about her being "my wife".

4)  Your first wife didn't want a long distance relationship, didn't want to move to be with you, and wanted to divorce you.  You had zero cares for this as exemplified by not following up with her on the divorce process, not inquiring about the divorce papers for you to sign, and not wondering why you didn't get a divorce certificate.  You didn't even confirm with her your marriage/divorce status when you met your second wife and wanted to marry her.  You just went and did it.  But now you are a caring husband to your first wife and want to "help her as much as I can"? 

5)  As another VJ member stated, your original post declared that you preferred to pursue an immigration visa.  Your above post about helping your wife as much as you can seems to be a manufactured justification for trying to get a visa for someone you really do not know anymore.

6)  What does your current family think about this?  Your children?  Do they not need your help and support?  Do you not share custody?

The 2nd wife was never legitimate,

no decree for 1st one was a part of

things, seem the UK was not informed

Apply for a tourist visa, U have to be

truthful in questions asked at the

interview

 They will ask about the the time

span away from wife if that comes up,

dont go n get a misrep bar though

@Nutcracker, you won’t get a non-immigrant visa because they will presume immigrant intent. .which has been correctly picked up on by everyone engaging in your post. 
 

The ‘‘presumption “ is an automatic , given the record :

visa violation on the F-1 , still married to a USC ..so even if there were no other issues/inadmissibilities , these factors can neither be waived nor explained away…no matter the argument. ..which seems to be :

” I am a wealthy man, with job, ties, kids in UK ..just want to visit my ill estranged wife” 

 

As for tossing about the immigrant visa option…well that would only be possible if the “marital union” part of the relationship gets rekindled.

So maybe , fly her in to the UK , log in some ( provable) time together and decide IF you TWO want to go down that rabbit hole. 
 

Your temporary bigamy …won’t be a huge hurdle, but I have a BIG spidey tingle that tells me you did not manage to prove up the bonafides to this American marriage during removal proceedings.

Just to let you all know that I have hired a lawyer who will take care of things - My plan is to get the ban removed so that I can visit US if and when I want to. My long term plan is spend time with my children and travel all across the globe, swim lakes, climb mountains and cross deserts. US is a great country and I really enjoyed the time I spent there as I lived it to the full but all the world is full of unique places, people, languages, cultures and landscapes. my thoughts to you all is to give your very best wherever you are and not get yourself distracted by things that do not concern you.

You cant get a ban removed, assuming it is not in place in error, you can apply for a visa and seek to get it waived.
