Retired joint sponsor

Hello,

I am hoping for some assistance:

 

We received the generic RFE for the I 864 stating that they can't determine if my husband is a valid sponsor or not. Last year his income requirement was $150 dollars less then the amount required for our household size (5) and the years below lower. We added a baby to our household this year. This year he will make about £10000 dollars more than the requirement.

 

We assumed that the letter was due to the previous years being lower and not consistent. We did feel like they did disregard the current income due to this. Obviously this was stressful. 

 

My husband's parents are more than happy to joint sponsor us. His father is a retired army vet who also receives disability while his mother works. We discussed our household size which I had researched would be 3 (them + me) and what income was required for that. He stated they receive that amount in half a year and had a decent amount of assets. They wanted me to research what is needed for them to help.

 

1) I see conflicting information about retired sponsors because it seems more a bit more complex. They said the tax return for them (filed jointly) was around 70.000 in the most recent tax year.

A: Statement: A Retired sponsor is an acceptable sponsor if they can provide above the 125% income for the household. Is this accurate?

B: Do we have to split the income between his parents from the tax return (eg state what comes from who) or is it the total amounts that is added on i 864?

😄 It appears that my husband's father would be able to do this without his mother's income. Does she need to fill out the other document or is it not needed?

2) I also read that some of the retirement/disability income is not taxable and might not show past history accurately. It seems like retirement is always taxable? How do I best deal with this issue? I understand that income does not always have to come from "paid work".

3) What documents does the retired person show as current income? I have seen that it might be confusing if I overflow them with too many documents.
