Hi all,

I have just received my green card in the post and it is a 2 conditional card not the 10 year card like I expected. I arrived in the USA the day after my second wedding anniversary so I’m confused as to why it’s a CR1. Does anyone know if I’m able to do anything to get this mistake fixed? I purposely waited until after the 2 year anniversary so we wouldn’t have to go through removing the conditions. The date I’ve been a resident since is the day I arrived in the states so I’m not sure what’s going on.

There seemed to be issues with the biometrics and I had to go to a USCIS application centre for a new picture but I’m not sure if that would have anything to do with the current issue.

Thanks!

You will have to file an I-90 for a corrected green card.  It's free of charge because it is a USCIS error.  File the I-90 online and submit a copy of your marriage certificate, entry stamp and the mistakenly issued CR1 green card.  It says to submit the actual defective green card but I would just submit a copy and hold on the original for now so you still have proof of lawful presence.  Whenever they are ready to start moving on correcting their error they would issue a RFE for return of the defective card.

Of the card's front AND back.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Sorry this happened to you. Just file the I-90 like the others have said. We wanted to avoid this so my husband waited a little over a month after our 2 year anniversary to come so they don’t get confused and send us a conditional green card and it worked. We received the card last Thursday and it was the 10 year card. Good luck to you.

Does this mean that if you arrive in US after 2nd wedding anniversary you will get 10 year GC? Even if the interview/granting of the visa happened before 2yr anniversary?

Yes. Some people use this delay tactic to get 10 year GC and avoid I-751. Certain lawyers frown upon it though. The safest bet is always enter the US as soon as you get visa.

Why enter sooner than later? Some examples:

1) US citizen spouse files for divorce before beneficiary enters the US as LPR.

2) There's new pandemic or new immigration policy restricting travel, either leaving beneficiary's home country or entering the US

3) US citizen or beneficiary gets sick

4) This also delays the clock for naturalization. The sooner beneficiary enters the US on immigrant visa, the sooner they can become a citizen.

The safest approach is to always get immigration benefit you can get ASAP and not wait even if it has some future benefits such as skipping I-751
