Hi everyone! 

I respectfully ask to see if I could get some input to see if I'm missing anything or could run into any issues prior to my wife's interview next week.   

My wife and I are both greatly in love but I'm concerned with the interview for several reasons. 

The first biggest issue is my past wife of 17 years who was also a foreigner passed away back in March 2024 due to cancer. At the time her and I where in the middle of a separation however we stayed together so I could help her since she was dying, We set our differences aside and halted the divorce . I met my current wife roughly two years ago we were just friends briefly talking while I was with my past wife just friends nothing more and not very often.   During the time my wife knew she was going to die she persuaded me to move on and finding someone else, so I wouldn't be alone and could find someone to love our children as much as she did. She knew about my current wife who I wasn't married to at the time and gave her blessing for me to move into working on building a relationship with someone else. 

While my wife was sick and becoming unresponsive etc I build up a relationship with my current wife. I'm was a father living alone with 3 kids and my current wife was helping me with parental advice etc.  We got VERY close over this period.  After my wife passed away I decided to book a trip to fly out and see my wife. A month before the trip I asked her to marry me and she agreed.  We go married in July I was in her country for 2 weeks.   My wife also has two children who are very active with my children , Our entire bond is very strong.  We gathered wedding pictures & photos, money from gifts , whatsapp chat , Skype call logs, letters from my family and friends some of these letters coming from higher up law enforcement agency employees etc stating they saw us together and knew about us and watched our wedding live .  We have a lot of support  In addition to this we were able to get our I-130 case looked at and expedited. Our PD was August 10th and we are already getting a interview.  Biggest reason for the approval and expedite where the children, who are greatly struggling with the loss of their mother , and two of them are developmentally behind on top of this I run a company that has 3 people working for it and it's been struggling to move forward due to me having to look after the children. 

I know my love and my wife's love is real and I have no doubts about showing that. My concerned is at the interview they will see that my past wife of 17 years died and I got remarried so fast I would think my past marriage history would help showing that I have a long relationship etc.  But I'm concerned that with one visit this will be a issue. I did have a second trip booked prior to my i-130 being approved Airbnb , flights etc and it shows the dates I submitted that as evidences as well we honestly had NO CLUE we would be this far so fast and thought we would have more time to build evidence.  So with all this what's your thoughts ? 

As far as the documents go  my i-864  I didn't make enough however I have a home worth $410,000 + a Tesla Model Y worth $21,000  I was roughly $28,000 short from the guideline for my household size.  On top of this I'm getting $28,000 income coming in from social security every year for the kids from my wife's death benefits.  I'm not sure if this income will be accounted for but it should reduce my household size regardless since the money is supporting my 3.

I do have a joint sponsor attached , My joint sponsor is married however has over $550k in liquid cash personal assets aging over 2 years in IRA and is over the required age for no penitialy , in addition to this w2 income that almost met the guidelines my joint sponsor was short $1,500 . I don't think any of this will be a issue do you ?   

Also my wife speaks spanish and not a lot of english , I speak very little spanish myself we use skype translation , When we are together we use translation devices + my step daughters are teaching me spanish they both speak english and spanish I don't think this will be a issue we can clearly show how we are able to communicate ?


Any recommendations we might need ?

Also question would they allow me to submit my 2024 taxes next year IF there was a issue with my i-864 or my joint sponsor since Jan is right around the way?  I'm self employed next year I can show we made more than enough without using assets or the need for a sponsor or additional income  if needed using 1099 , etc

I'm confused about how you got an interview so quickly.  Sounds like an adjustment of status instead of a visa interview.  Please clarify.

 

No, you cannot file your tax return before the end of the year.  Your equity in your primary residence is not considered liquid.  Time to become an A-Student of the I-864 and it's separate instructions.  If you are not a well qualified sponsor, you'll need a well qualified joint sponsor.

No not adjustment of status. My wife lives outside of the USA. We got a lot of help getting this push through fast. Her Embassy interview is next week.    I understand I can't file 2024 since its not January yet but will they allow me to submit that next year if need be ? I don't see why not since the case has a year to qualify before expiring. If you get a 22g form due to income and can show you satisfy the requirements that's all that should matter correct we are talking about less then 60 days before 2024 ? 

As far as my joint sponsor goes I should be good correct ? $500K IRA over the age + $1,500 short of required guideline on w2 personal income taxes

Also with this case being expedited so fast how does the play a roll into the visa interview ? I'm sure it has some type of effect, one being they know we didn't have a lot of time to gather more evidence , Also maybe my wife getting her visa faster on the spot specially with all the higher up officials pushing this through for us?   We honestly wanted more time because I had planned to make several trips to see my wife.  I still have my trip next month booked and hopefully they will see that we didn't see us getting through this process in less then 107 days we were told it would of taken 24 months
