Accidental Medicaid through Helthcare

Hello,

 

i have a little situation, my wife arrived here in US on K1 visa and we just recently applied for AOS. However, a month ago i applied for health insurance through marketplace and when i did that i explained to the lady on the phone that she cannot apply for any government assistance. The lady on the phone didnt check anything for medicaid and the application went through as usual. Recently i moved to a new place and i had to call Marketplace to change the address of file, so i called them another lady picked up the phone and when i told her i wanted to change the address she said i have to resubmit the application again and re-pick the plan. When i asked her is that the only way and i am only trying to change the address and she said yes thats the procedure. So as we were going through she asked about medicaid, i said i dont need it and we cant apply for it due to immigration so i guess no, we do not qualify, so she marked it and then she tells me now we have to wait 30 days for the answer from medicaid if we approved or denied. I freaked out and told her no i do not want to apply for medicaid and no assistance and why would she do that. She replied that due to my wife being pregnant she qualifies for one, i explained to her again that i cannot be applying for any government programs or assistance as it will deny her application. So the lady went back into the application and removed the check mark and said "Oh thats why it was left blank". I got furious. I asked now what? it will go to medicaid and how can i get it removed. She assured me that it didnt go to medicaid since she removed it and nothing wont happen and proceeded with submitting my application and choosing the same plan that i had. So, today i receive a letter saying i need to provide proof of SSN or that my wife applied for SSN. That means it did go through to Medicaid like i suspected and that second lady in the marketplace lied to me. I tried calling Medicaid to null the application but the robot refuses to transfer me to a human, and when i do get through it, it says everyone is busy and call back later and hangs up.

 

Medicaid wants proof by Dec 2nd which im not intending to provide them with anything since i never wanted it in a first place.

 

Did anyone have similar situation? Am i screwed on the AOS now? If so, what are my options?  Any advice will be appreciated

 

TL;DR: Healthcare marketplace signed my wife up on accident when i told them not to and now i received the letter from Medicaid. While at the same time i applied to AOS. Am i in trouble?

Some states do offer pregnancy healthcare to all, including immigrants.  Not sure where you are located, but you might want to verify what is the best option for your family at this time.  https://www.medicaid.gov/about-us/where-can-people-get-help-medicaid-chip/index.html

1. The issue isn't applying. The issue is USING it but....

2. GC HOLDERS only qualify after 5 years residency. She isn't one.

3. Pregnant woman are exempt from using public benefits.
