Hey guys, i have a question:

my wife is a greencard holder and she is filing a re-entry permit  to protect her greencard because she has a phd to finish outside USA. As im her husband she wants also to file a spouse visa to get also greencard later. Can she file for a re-entry permit and also a spouse visa at the same time for the reason to not waste our time waiting for my documents to finish once my files are accepted by USCIS ?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

How long will she be outside the US? Current PD for F2A visas is January 2022, so if she petitions for you now the wait time is likely at least 3-4 years.

 

I can't speak to the part about filing while outside the US, especially if she is LPR and not citizen - I would think this would attract extra scrutiny at the very least.

You posted "We entered the US, the main applicant and myself and changed my address at the cbp at the airport. But i read that the postal service address should be also changed. I dont know if it will be automatically changed. Thats why im asking. And im not living with my sponsor, we are living in a different state. I dont want my papers to go to the sponsor, i want them to sent to me"

Are you and your wife sharing this account? Your post history is really confusing. How did your wife get her green card and how long has she lived in the US since getting it?

And we have been like 6 years together and we have already proof for it

 

Then she can't apply for a re-entry permit anyway, if she's already left the US.

She needs to return to the US to file for the re-entry permit.  She can also file an I-130 for you.  It will be a few years before you can enter the US as F2A.

OK.  She can file for a re-entry permit when she is in the US.  She can file an I-130 for you at any time she wishes.
