I filed provisional (5 year rule) late december 25 and had my interview yesterday and was handed the n-652 stating that i passed the test but a decision cannot be made yet. I am still married to my US spouse but she moved out of the country 2 years after i moved here. We shared a household for 2 years. The IO asked me these questions about my spouse who filed for divorce about a year after i got my GC. The IO also asked me if we have children which we don’t. My wife had a miscarriage around the same time when she filed for divorce. I didnt mention that to the IO. 
the IO said that there might be an issue with the time requirement as far as me and my wife living together. Now im freaking out that they deny it or even cancel my GC…

Sorry to hear it. Yes, your fears are not ungrounded. Are you planning to consult an immigration lawyer? You're in a tricky situation.

That depends on the decision they make. If they just deny it i might leave it alone. If they question my GC i will have to consult with a lawyer. The IO also asked if my wife was present during the GC interview which she was. I thought i had already provided proof back when i filed for adjustment of status. Now the IO tells me she’ll have to review my case.

Your entire immigration history is verified again during N-400. Marriage may be required to be proved again at this stage. If you spoke to a lawyer before applying they could have suggested not to apply or how to prove your marriage on spot at the interview.

 

I'd start consulting a lawyer already, before you're given RFE deadline or things develop further in negative direction. Sometimes counteractions take time, which you may not have in the future.

True.  The IO also said she would reach out to me if there is anything she needs and that i would hear something back within the next couple of weeks.

@KtotheL You may want to consider talking to Jim Hacking of Jam Hacking immigration law. He has a YouTube channel https://www.youtube.com/@HackingImmigrationLawLLC. He does immigration QA shows about 3-4 days every week. I have watched a few. He is honest, and keeps callers' identities private [no real name, no camera] gives the right advice at no cost, and I never have seen him trying to grab anyone to be a client.

 

Note: I am sharing this just from my experience of watching his live sessions. I am not associated with him or his firm in any way.

That's probably one of the most accurate estimates we've seen in a while... 😂😂😂
