ADJUSTMENT OF STATUS - proof of bona fide evidence of marriage

Hi all! Im taking a long shot here but hoping somebody can help. 

 

So we dont have a lot of legal documents with both are names

i.e :

• Deed to property showing both names 
• Mortgage or loan documents showing both names
• Lease agreement showing both names
• Driver’s licenses or IDs showing the same address
• Bank statements showing both names
• Utility bills showing both names (electricity, water, gas, trash, cable, internet, cell phone, etc.)
• Correspondence from friends, family, or businesses showing both names

 

We only have my husbands updated life insurance, medical insurance with my name and an updated Emergency Data document from the DoD with my name on it too. 

 

We are filing our AOS through rapid visa and they are asking for: 

 

• Explanation letter signed by the Petitioner why there is limited proof of bona fide evidence of marriage. It must be notarized.
• In addition, we will need both of your signed comprehensive letters that include a statement/narration about your relationship (how you met, got engaged, details about your marriage, and future plans)—signed and prepared individually to support the bona fide marriage evidence. Just a signed statement from both and doesn't need to be notarized.

 

Anyone has a sample for this two I can maybe get an idea of what to write? would be a big help! TIA!

1) Why use RapidVisa? They're not lawyers and not responsible for your case. Either study everything yourself and file on your own or hire a real lawyer.

2) You need a strong case, not a weak one. This requires opening joint accounts etc to show bonafide marriage. Unless you want to get RFE / NOID / stokes interview, file a strong case from the start.

I second this... Rapid Visa will do nothing but cause you headaches. If you're going to spend the money anyway, may as well hire an attorney. Co-mingling of finances and evidence of co-habitation as a married couple are the gold standards of a bona fide marriage in USCIS's eyes. A letter explaining why you don't have these things and a story about your relationship will hold no weight with the adjudicator when processing your application for AOS. Rapid Visa is not helping you here. My advice is to file with everything you have currently and while your AOS is processing, work on getting joint accounts opened, get both of your names on the utility/mobile phone bills, etc. so that you have this stuff ready to submit in case you get an RFE or an interview. USCIS knows that when adjusting from a K-1 there is not an abundance of evidence at the AOS stage, so do the best that you can.
