PASSPORT RETURNED AFTER SENT AS REQUESTED DURING INTERVIEW WITH NO INSTRUCTIONS. STUCK IN ADMINISTRATIVE PROCESSING FOR 5 MONTHS NO OTHER INSTRUCTIONS FROM MONTREAL. HELP PLEASE

Hello,

 

I am under the EB1 a category and I went for my interview on March 11 2024, I was handed 221 g to submit husband's clearance and our passports.  Submitted in July 12 received July 15, all of a sudden our passports was just returned without any other instructions.  What do I do. What does this mean. Has this happened to anyone. Our medicals has long expired . Do you think it was returned because of the medicals? They haven't requested it yet. What do I do. Freaking out here. Any help or anyone experienced this

The first person to speak to is the Lawyer handling the case.

That means that its still in AP, something is wrong with your paperwork where they need more verification from your home country and they are not getting it, so thay have retuened your passports till they do, after that they will ask for your passports back.

Well my husband sent an email requesting his passport and they returned all the passport including his. Could that be why? They didnt request any information from my home country. I moved to Canada when I was 14 years old so they didnt need any documentation from my birth country according to the officer

Yes, that could be it. When did your husband move to Canada? Did he submit PCC from his home country?

They only needed his police clearance from Canada  as we didn't have it during the interview.  I am an applicant and he is a dependent.  They didn't ask for his police clearance from his birth country

Did you get a 221(g) letter from the consular officer?

Yes I got a 221 g requesting his police clearance from Canada and our passports which i sent it on July 13, recieved July 15th and then they returned it back

okay, have you tried calling them? The numbers to the visa unit are 418-478-1369 or 438-793-1947. Do you have an immigration lawyer?

I don't have an immigration lawyer. I called and they had no information to give to me

Get an immigration lawyer that specializes in consular processing, at this point it might be worth the investment. They have ways to engage the consulate and get a response from them.

I don't think that would be money well spent personally. A lawyer can't speed AP up anyway, it takes as long as it takes. So OP would basically be paying somebody to be told the same thing as they've already been told anyway. 

 

@FaithinChrist, is your husband's country of birth Pakistan? An EB1 application with no lawyer is very unusual, did you have one for the initial petition?
