Each case is it's own animal.... we saw lots of December filers approved before us. And our "My Progress" tab was all over the place, even went to 40 months until decision after the biometrics. Just hang tight.... your officer may have a bunch of backlogged applications, etc.

After a year of AOS. This is a normal historical time for AOS in the last few years.

Things are slowing down. There's hiring freeze for government agencies, I'd imagine USCIS staff is also going to be stretched because of this.

So i am starting to see some videos or tiktok for our the possible interview questions.. i come across one from an immigration attorney (clairekimlaw) in tiktok, and it did confused me a bit.

 

"Have you ever violated the terms of your non immigrant status?" 

 

- as K1 holders are we violating it if we have submitted our AOS after the dates stamped on our passports?? ( tho we followed the getting married within 90 days).

 

-if yes, you will be automatically pardoned as you are an immediate relative

 

 

However, where do we belong?? Yes....or No?? Hahaha. 

 

You can look at that tiktok account and scroll it with this title. (I hope attaching this tiktok account here is fine. I wanted others to see it too and I may have understood things differently)

If you did not file before your 90 days then technically, yes you did violate the terms of your non-immigrant visa. But it does not matter because as an immediate relative of a USC, those violations are forgiven and will not jeopardize your AOS process. Lying about it would put you into jeopardy though. So if you filed past your 90 day period and they ask you this question in the interview, the right answer is yes.

 

This is not a "new" question in the AOS interview btw. This is asked in Part 9., "General Eligibility and Inadmissibility Grounds", Question 13 of the I-485. Often times the Interviewing Officer will have the applicant verbally answer the Eligibility and Inadmissibility questions during the interview. Nothing unusual or to worry about :)

Anyone else notice the "My Progress" tab missing from their case info in the my.uscis.com portal for the last few days? Are they finally getting rid of the most broken feature of any website ever made? :D :D :D

Yes, people noticed. I doubt they're getting rid of it. It's just broken, maybe some low wage software engineer intern will use ChatGPT to find the problem and push the "fix" (not really fix, but make it work again) sometime...

Hi 👋. Any update regarding AOS from anyone? This waiting game is stressful. I got my written driving test today. I have had a driver’s license for 20+years, so it would be really funny if I failed 😂. My son’s K2 is moving nicely. Scheduling his interview this weekend. Hopefully 🤞 all is good. He is 18 going on 19 but has Asperger’s. I’m worried that he’s going to blab sthg out …. He is highly functional and smart (pre med student) but very VERY awkward in social settings. 🤦🏻‍♀️

Good luck on all the appointments! Jaycel failed her written test at the DMV... It was mostly due to trying to interpret American English in the questions presenting driving situations in written form. She's been driving for years but she had a hard time trying to figure out exactly what they were asking. I felt so bad.... she was devastated but she gets another try this Monday.
