hi guys!

whats happening around? i guess i didnt do much reading enough to know where to send the packets nowadays... i sent our I130 to Tsc, now waiting for NOA for the sending off of the I129,,, or should i do anything different? how? what? and how? what will happen to our packet in TSC? anyone who can give me a link please regarding these new processing info...... they said should have sent the packet together in either VSC or CSC... if thats the case im dead meat.. what will happen to my Packet in TSC??? should i send the I129F asap????

please anyone.... any answer will be of great help... thank you....

California Service Center - Texas Service Center - Manila US Embassy

August 2007 - filed I130

September 2007 - filed I129F

April 24, 2008 - interview and VISA APPROVED!

May 02, 2008 - visa in hand, had the CFO stamping done at once, bought ticket online...

May 03, 2008 - flew to US to be with stinky love...

July 22, 2008 - Sent AOS Package to CHICAGO Lockbox

July 24, 2008 - received package

July 29, 2008 - NOA for AOS and EAD

Aug 01, 2008 - Touched....

Oct 01, 2008 - Received EAD

still waiting on AOS

No change in procedure, you send the I-129F to the Chicago address with copy of I-130 NOA1

Note, The K-3 can be an expensive visa undertaking, AOS from K-3 is $1010, you just may want to stick with the CR-1, it takes just a bit longer than K-3, I have been seeing cases where the CR-1 reaches the consulate at the same time or a few weeks later, and the consulate tosses the K-3 in favor of the CR-1.

The CR-1 results in green-card, and work authorization upon entry to the USA the K-3 does not, you then have to file AOS for $1010, and can wait quite a lot of time waiting for Green-Card.

I agree with taking a long hard look at whether to file the I-129F. Knowing what I know now, if we were starting the process now, I would choose to wait an extra couple months to save the difference in cost and trouble, times two beneficiaries.

hi guys,

based on what i have read and understood... correct me if im wrong please.... is it just right that i have sent the I130 to TSC and will wait for my NOA and then send our I129F to the service center depending on my residence?? depending on the direct filing procedure released by USCIS??

so, question is.... do i have to panic that i have sent the I130 to TSC??? i have sent the correct amount and everything needed with that packet... hope that goes well... but i will also take the advice of calling the NVC to check on our case number so that we can send the I129 at once (so is it ok to send the I129 even without the NOA from the submission of form I130???? ))

another question..... in the new form I130, it says there that i need to send the I130 packet to the service center where i reside... and that in my case is TSC.... and it also says in the I129F that "if you are a USC, and filing a K3 petition for spouse, i have to send the I129F to The Service Center where the underlying I-130 petition is currently pending. Use the address listed on your most recent receipt notice or transfer notice and include a copy of that notice with your Form I-129F." and that in my case is??? will it depend on what the NOA says???? or where my case will be forwarded to??? or will just call NVC to check where my case is pending at....???

this sure is confusing... lol...

If you paid by check, print out the front and back of the cancelled check and send it as proof of filing. If the number stamped on the back of the check starts with WAC, send your petition to California. If it starts with EAC, send it to Vermont.

Again consider carfully the K-3, you may want to not file the I-129F, and just stick with the I-130 process. The CR-1 seems to take the same time through Manila, and is a much better visa, it is an IMMIGRANT visa.

Keep in mind, USCIS in many cases lately hold the I-130 petition when the I-129F is filed, they assume you will be perusing the K-3, and hold the I-130 to prevent NVC and Embassy extra wasted paperwork.

After receiving NOA2 for the I-130 you may want to call NVC a few weeks after to confirm that they received the I-130 case and will send it to the Embassy. If they don't receive it, you may have to file I-824 to keep the I-130 moving.

You are not likely to have an option. If you filed an I-130 for K3, your I-130 is to be held until you adjust status. This new policy went into effect last fall. Read here:
