No not married, no kids, just a job in back home country which also is more of online work. She comes from a food background n loves to study that field always wanted to open a food business since childhood

 

Also another question if we apply extension n she stays till a decision is that time illegal??

Or they exit n reapply for visit or student visa. They have a pakistan passport. What are the chances of approval? Regular traveler to various parts of the world. The family in usa is either citizen or on GC. Plz help 

In general a person coming to the US on a B2 visa should spend double the time outside the U.S. than inside.  So coming, staying the max allowed, leaving for a few weeks, or going to a third country, then re-entering will eventually come to the attention of CBP.  Again, a risky proposition especially for someone that has a B2.

Not illegal, but very risky, see my previous response.

A student visa is highly unlikely to be granted if all their family is in the US. Frankly I think they're going to struggle to get another B visa.

 

They should leave by 3rd December (aim for the week before just in case of flight delays) and they can try and return again but wouldn't risk trying to come back too soon personally. It sort of sounds like they're trying to live in the US on a tourist visa, which obviously isn't allowed. 

 

Have you or your parents petitioned for her to get a green card?

I am not sure how studying the food business in the US would help open an operation in Pakistan

Forget the student visa...just extension so he can stay for another month or 2 n then go back ...is that also too risky

No, forget the extension. They’re only granted for a very good reason i.e. if the applicant is in hospital and can’t be moved. Far too risky as the chances of a refusal are high. 
 

If you want your sibling to travel with your parents to help them, it would be better for your parents to move their travel date.

Yes.  The average processing time for the I539 is 3-6 months, and if she stays a couple of months and the extension is denied, she will most likely lose her B2 due to an overstay.  Filing the I539 does not grant a grace period if it is denied.

Its so hard for simple families who have no bad intentions to even have some good time together. Then they talk about family ties :(

Your sister has a B2 visa which gives her a huge advantage over a great many folks all over the world.  I think the main point most of us responding here in this thread is don’t abuse that privilege as it can easily be taken away.

 

Btw, many of us have families all over the world, and many of those family members do not have a B2 to allow for a visit to the U.S.  Yes, immigration and international families sometimes do not mix, but luckily there are a lot more options to allow for staying in touch.

The world is a big place.  Plenty of places to spend quality time together.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Tourist visas are not for family reunification or living in the US. She’s been here for months, that’s much more than what any average tourist takes off for vacation.

Mine have visited but I think the longest was just over 2 weeks, months would be pushing family unity

Most people can only take a week or two a year to be with family. Jobs and other commitments don’t allow months in another country for most. 
 

If your sibling wants to live in the US with their family then they need to acquire the proper visa.
