hi all would like to know. i filed I-130 for my wife under her maden name. the reason i did this is because i had all paper work filed out before i got married and figures when it comes to name checks and all the processing it would be easier for the uscis people to figure out who i was petitioning for. so my question is when would be a good time to change her passport to married name at the interview or right before it or tell counselor it need to be changed I-130 is 62 days into processing thank you all for the help

When did your wife's name change legally?

we got married on may 7 2007 so that would be the day i guess it would of changed

I got married December 30, 2005 but my wife's name hasn't changed. I repeat, "When did your wife's name change legally?" Are you sure it changed at all? What name is in her currently valid passport?

ok pshbrk i understand i hope so its not that big of deal her name is the same on her passport as what i filed and what is on marrage lic. it hasnt changed till she wants to use my last name am i right or untill we change it or untill we sumit some document saying it has changed

A name change is a legal process. The process varies based on where and when it is undertaken. If I understand you correctly, there has been no official name change. If she wishes to take your name after she arrives then follow the prescribed process in your State. Before you do, check into what it will take to change all her identification including passport.

Just to clarify, a visa for Maria Smith is not going to be placed in Maria Garcia's passport.

If you change Maria Garcia's name to Maria Smith and then want to travel abroad by air, you'll have to book a ticket for Maria Garcia because Mary Smith cannot travel using Maria Garcia's passport.

My wife doesn't mind people calling her Mrs Myfamilyname but it isn't her name.

ok, I had the same similar situation

My new conditional residence visa had my birth name aswell as my passport, and the green card

How ever when I applied for SSN I showd my birth certificate and my marriage licence and they gave me my SSN with my marrid name,

So now, my residence has my birth name and SSN, drivers licence and ID has my husbands name.,,,,

And its ok

It's ok but when you buy your ticket for any international travel, the ticket must be in the name on your passort.

Most of us do pretty much the same thing about the names. Don't let her change her name on anything until she gets over here with her visa. Even if she changes it before she leave, but after she gets the visa, something could come up when the check her in at the POE. Just better to be safe and wait until she is here and safe in your arms.

Actually, if you think about it, many married couples here go without changing the name. That has to do with people who have a well established name and don't want to confuse everyone. There is however some confusion in the Philippines as from what I understand the name change is "automatic" after the wedding. This is what I here from over there, but we are dealing with American laws here since the visa will be for her to come here.

You figured wrong. The I-130 would have been the easiest place to start using your wife's married name with the US government. The next opportunity will be when she submits her visa application, after the I-130 has been approved.

For the passport she deals with her own government, not with the USCIS.
