Timeline

I have read up on the different petitions K-1, K-3, CR-1 why is it that there are different requirements as far as number of years required of tax records? I had thought that if you were employed you only needed the last years records and if you were self employed you needed three years.

Now just reading again I see that a CR-1 needs the last three years tax records While a K-1, K-3 only needs one years records. Am I just stupid or is there a type somewhere?

If you are talking about I864 (affidavit of support),

CR-1 also only needs to provide proof of one (last year) tax return, BUT we have to give AGI information from 3 years of tax returns.

Showing 3 returns is optional.

AGI= adjusted gross income. This is a line in US tax return. This is the number that you report on the forms when asked for US citizen income from previous years.

One might consider that different affidavits might have different evidence or supporting documentation requirements....

There are different requirements for meeting the public charge provisions of the law for immigrants than for non-immigrants. About 10 years ago different, more stringement requirements were implemented for immigrants.

What you write here about income tax information is not correct. Part of your confusion may be due to failure to properly distinguish between the requirements for non-immigrant v. immigrant visas, and another part may be due a change in requirements for immigrant visas last year when the USCIS finally replace the interim rules for immigrants with the final rules.

AGI?....Unless I'm looking at an old form or I'm missing it, ..It says on the I-864..Item Number 23

"Current Individual Annual Income" Enter your "current earned or retirement annual income" that you are using to meet the requirements of this form and indicate the total on this line. Annual current income is different from adjusted gross income...If I'm wrong, someone correct me

Sometimes they are the same number but yes, the gross income is the correct number if using last year's annual income. One may also annualize this year's income if they got a raise or new job or in some cases took a cut in pay, retired or lost their job.

Facts are cheap...knowing how to use them is precious...

You've got it right - item 23 is for current income expressed on an annualized basis. For many people that is probably equal to their latest pay statement expressed on an annual basis (hourly salary x 2080, or weekly x 52, or bi-weekly x 26, etc.)

Item 24 is for past year's reported income, line 22 on a 1040 or 1040A. For many people this number can be greater than their income from employment, because it will include interest earnings and perhaps other types of income.

If the income from other than employment is significant you might want to include an estimate for the current year on line 23 as well. People with sizable investments, or rental properties, for example.
